492
fireplace mantle was separated from the wall by two to three inches creating
a serious fire hazard , and that the exterior chimney itself was leaning away
from the house . He indicated that this was the first case in which it had
been necessary to obtain an inspection warrant . In response to question by
Vice -Mayor Henderson, he indicated that it would not be economically feasible
to rehabilitate the house .
Following a brief discussion , Mr . Longo was invited to speak on his own behalf ,
and on advice of the City Attorney , was sworn in by the City Clerk .
Mr . Joseph Longo , 682 Oakview Way , indicated he
had made corrections to the separation of the
fireplace from the wall , and had placed a "4x6 "
underneath the house where the fireplace was
located . He stated there was nothing wrong with
the gas floor heater , and felt that the deficien-
cies cited were small matters and also that most
had been corrected . Mr . Longo referred to claim
in the report regarding a crack in the foundation ,
which he felt was insignificant .
Mr . Longo responded to several questions by Councilman Rhodes , indicating that
if given the time , he would be willing to vacate the premises for the purpose
of rehabilitating it to the satisfaction of the Chief Building Official . With
regard to failure to admit Building Inspector to the premises to perform in-
spection , Mr . Longo denied that access was refused .
Mrs . Mary Daniels , 2424 Jefferson , stated on oath
that she had at the time just been released from
the hospital and asked the Building Inspector to
come back on another date because there had not
been opportunity to clean the house . She stated
there were only two persons living in the house ,
herself and her daughter . —
Mr . James McLane , 2416 Jefferson Avenue , in his
sworn testimony advised he had lived at that
address for two years , next door to 2424 Jefferson .
He stated that the house was in deplorable condition ,
and advised that he had observed makeshift attempts
of the owner to make sewer repairs . He also stated
that efforts to keep the lawn cut is made only if
the Fire Department is called out to ask them to do
it .
Chief Building Official , in response to Mr . Longo ' s comments , advised that he
would stand on his report , and reiterated his earlier statement regarding lack
of cooperation from the owner and tenant . At request of City Attorney , he
commented briefly on the reference to a " crack " in the foundation , advising
that the building was constructed in 1925 and was in stages of deterioration
due principally to neglect and lack of proper maintenance . He stated that
portions of the building had no foundation , and that the portion where the
crack was observed , and there might be others , was due to settlement .
Remedial action necessary to restore the foundation would involve jacking up
the building and then complete repair of the foundation around the entire
perimeter . Simple patching would not be sufficient . With regard to the
fireplace , he advised that it would have to be removed and new foundation
constructed . Responding to further questions by City Attorney , he advised
8/13/73
Reg . Mtg .
