288 <br /> Planning Director advised that the height limit was 35 feet , or the <br /> same as for "R- 1 " and "R -2 " Districts , which could be three stories , <br /> Mr . Gardena indicated he understood height <br /> limitation to be 30 ft . , and that the architect <br /> was working below that limit . <br /> City Attorney quoted from the Zoning Ordinance relative to height <br /> regulations for RG District , but added that Council should be aware <br /> that they were not to consider at this time any particular develop - <br /> ment of the property since zoning only to be considered at this public <br /> hearing . <br /> There being no communications or further oral discussion , Councilman <br /> Weymouth moved to close the public hearing , seconded by Councilman <br /> Williams and carried . <br /> Councilman Norris moved to affirm the action of the Planning Commission <br /> and DENY the application for rezoning , seconded by Councilman Leipzig <br /> and carried on roll call vote , Councilmen Rhodes and Weymouth voting no . <br /> (MINUTE ORDER #73 - 15) <br /> PUBLIC HEARING , consideration or revocation of Use Permit , MARY JANE <br /> BYWATER , for the storage of contractor ' s equipment at 301 Spruce <br /> Street , in an "IR " ( Industrial Restricted ) District , declared open <br /> and affidavit of publication ordered filed . Staff report indicated <br /> that the Planning Commission , after a public hearing on December 19 , <br /> 1972 , recommended to the City Council that Use Permit U71 -l1 be revoked , <br /> based on partial or total noncompliance with certain conditions of the <br /> Use Permit , (For full report , see City Clerk ' s file - Planning - Use <br /> Permits ) <br /> Mr . Charles Stuhr , 5012 Mission Street , San <br /> Francisco , attorney representing the owner- <br /> contractor , presented several copies of docu- <br /> ments which he believed were pertinent to the <br /> matter , He stated that he supposed the basic <br /> question was , "Had Bywater Construction Company <br /> abided by the Use Permit . " He then reviewed <br /> in detail the history of the transaction and <br /> procedures followed , beginning with the grant - <br /> ing of the Use Permit in April , 1971 . <br /> Mayor Keckley questioned Mr . Stuhr with respect to an inspection made <br /> in December , 1972 , reported in Planning Commission Minutes , concerning <br /> status of compliance with conditions of the Use Permit , particularly the <br /> landscaping plan , which was never approved . Mr . Stuhr indicated plants <br /> were installed in October , just prior to sub- freezing temperatures , and <br /> if they could not be saved , new plants would be put in .
