288 Planning Director advised that the height limit was 35 feet , or the same as for "R- 1 " and "R -2 " Districts , which could be three stories , Mr . Gardena indicated he understood height limitation to be 30 ft . , and that the architect was working below that limit . City Attorney quoted from the Zoning Ordinance relative to height regulations for RG District , but added that Council should be aware that they were not to consider at this time any particular develop - ment of the property since zoning only to be considered at this public hearing . There being no communications or further oral discussion , Councilman Weymouth moved to close the public hearing , seconded by Councilman Williams and carried . Councilman Norris moved to affirm the action of the Planning Commission and DENY the application for rezoning , seconded by Councilman Leipzig and carried on roll call vote , Councilmen Rhodes and Weymouth voting no . (MINUTE ORDER #73 - 15) PUBLIC HEARING , consideration or revocation of Use Permit , MARY JANE BYWATER , for the storage of contractor ' s equipment at 301 Spruce Street , in an "IR " ( Industrial Restricted ) District , declared open and affidavit of publication ordered filed . Staff report indicated that the Planning Commission , after a public hearing on December 19 , 1972 , recommended to the City Council that Use Permit U71 -l1 be revoked , based on partial or total noncompliance with certain conditions of the Use Permit , (For full report , see City Clerk ' s file - Planning - Use Permits ) Mr . Charles Stuhr , 5012 Mission Street , San Francisco , attorney representing the owner- contractor , presented several copies of docu- ments which he believed were pertinent to the matter , He stated that he supposed the basic question was , "Had Bywater Construction Company abided by the Use Permit . " He then reviewed in detail the history of the transaction and procedures followed , beginning with the grant - ing of the Use Permit in April , 1971 . Mayor Keckley questioned Mr . Stuhr with respect to an inspection made in December , 1972 , reported in Planning Commission Minutes , concerning status of compliance with conditions of the Use Permit , particularly the landscaping plan , which was never approved . Mr . Stuhr indicated plants were installed in October , just prior to sub- freezing temperatures , and if they could not be saved , new plants would be put in . Mayor Keckley 2 /5/73
