There was brief discussion concerning <br /> proposed use of the property , as well as ownership of a 20-foot easement , <br /> of which Mr . Bunyard advised ten foot width was owned by adjacent oil <br /> company , but used by either owner . <br /> Planning Director reviewed the history of the site since 1967 to the <br /> present , and that while Planning Commission was considering amendment <br /> to the Zoning Ordinance relating to side yard requirements the original <br /> application for variance came before them, which they did grant at the <br /> time . However , more than a year had passed since that action, and the <br /> application must now be considered under the Ordinance as it now exists , <br /> Vice -Mayor Henderson called attention to the conclusion of the staff <br /> in its report tlat no basis could be found for granting the Variance , <br /> but rather found that granting a Variance would be a grant of special <br /> privilege not available to other property owners similarly disposed under <br /> the terms of the Zoning Ordinance . <br /> Vice-Mayor Henderson moved to AFFIRM the action of the Planning Commission <br /> and deny the Variance , seconded by Councilman Norris and carried . <br /> (MINUTE ORDER #72 - 98 ) <br /> AWARD OF BID , Municipal Launching Ramp Pier . <br /> Approval had now been obtained from all agencies required prior to <br /> award of contract . Staff recommended award to the low bidder , Western <br /> Dock Enterprises , Novato , in the amount of $3 , 721 . 00 (Alternate A ) . <br /> Funds were available in the current budget . <br /> Vice-Mayor Henderson moved to adopt RESOLUTION NO , 6712 AWARDING CONTRACT <br /> FOR CONSTRUCTION OF A LAUNCHING RAMP PIER AT THE MUNICIPAL MARINA ; REJECTING <br /> ALL OTHER BIDS RECEIVED ; AUTHORIZING EXECUTION OF CONTRACT FOR SAID WORK ; <br /> AND DIRECTING RETURN OF SECURITY DEPOSIT , seconded by Councilman Rhodes <br /> and carried on roll call vote . <br /> REPORT OF BID OPENING, Tennis Courts Resurfacing, Mezes Park . <br /> Three bids were received for the project as follows : <br /> Base ' Bid Alt .
