4 1 contrary . The Committee recommended opposition to SB 437 , 7 . Sidewalk Repairs at City Cost . SB 490 would require cities to maintain and repair sidewalks and prohibit them from requiring the owners of abutting lots from paying the cost thereof . It is estimated that for this City, alone , some $25 , 000 to $ 50 , 000 per year additional burden to all taxpayers would be incurred as a result of enactment of SB 490 . The Committee recommended opposition to SB 490 . 8 , Bicycles - Hazardous Grates Prohibited . AB 1101 would provide that , commencing on January 1 , 1973 , the State , counties and cities shall install on highways , roads and streets only those types of grates which are not hazardous to bicycle riders . As presently drafted , the bill does not provide for any State funding . Therefore , the anticipated substantial costs required by the bill would have to be borne by the local taxpayers insofar as city streets are concerned . As presently drafted , the Committee did not recommend support of AB 1101 . However , the Committee was of the opinion that AB 1101 does have substantial merit in that it provides protection for a sign- ificant portion of our population . The Committee , therefore , recommended that the Council support an amendment to the provisions of AB 1101 which would provide that the costs incident to compliance with the Act may be paid with gas tax funds . Vice -Mayor Henderson also suggested that a letter be sent to the author of the bill recommending that an amendment to the Bill be made . Copies of this letter to be sent to Senator Gregorio and Assemblyman Arnett , 9 . Private Construction - Public Liability . SB 874 provides that a city or county which has issued a building permit for residential construction shall be liable for the cost of repairs , and actual damages , to any person lawfully on the premises where such repairs or injury are caused , or made necessary by, the construction of the building in violation of building code requirements . - The bill would substantially expand the scope of liability of local public agencies to include circumstances where the public entity could be liable for code violations of private parties on private property in constructing private buildings . The Committee recommended opposition to SB 874 . 10 . County Service Areas . AB 974 would permit proceedings for the establishment of a county service area to be instituted by a written request in the form of a resolution adopted by a city council . AB 974 would provide a vehicle whereby 5-15-72
