PUBLIC HEARING , Application of SAVERIO VACCARO to amend Section 13 . 2 ( d ) , <br /> Zoning Ordinance , No . 1130 , relating to permitted used in the " CN " <br /> "Neighborhood Commercial " District , to permit sale of wine and beer in <br /> restaurants , declared open and affidavit of publication ordered filed . <br /> Planning Commission , after a public hearing on April 25 , 1972 , recommended <br /> that Council approve amendment to Zoning Ordinance to allow sale of wine <br /> and beer in restaurants as a conditionally permitted use in the "CN" <br /> District . <br /> At request of Vice -Mayor Henderson , Planning Director provided a brief <br /> statement concerning initiation of the application , in connection with <br /> a restaurant , Planning Commission proposed restriction such that sale of <br /> beer andvine only be permitted , and that a Use Permit be required . <br /> Mr , Kenneth Carey , 626 Jefferson Avenue , advised <br /> he represented Mr . Vaccaro , who owned property in the <br /> Roosevelt Shopping Center , and that he had not realized <br /> " CN " District did not permit selling wine and beer , <br /> therefore made application to change the Ordinance . <br /> He noted that in the same shopping center , off- sale of <br /> liquor is permitted , but not wine and beer in a <br /> restaurant . <br /> There being no communications or further oral discussion , Councilman <br /> Weymouth moved to close the public hearing , seconded by Councilman <br /> Rhodes and carried . <br /> Councilman Rhodes moved to introduce Ordinance amending Section 13 . 4 of <br /> Ordinance No . 1130 , the Zoning Ordinance of the City of Redwood City , <br /> relating to uses in the Neighborhood Commercial District , seconded by <br /> Councilman Weymouth and carried . <br /> Application of HENRY and ANGELA M , MILLER , to resubdivide one parcel into <br /> four parcels with exceptions requested , property being located in Oak <br /> View Way near Laurel Way , in "RH " (Residential Hillside ) District . <br /> This matter had been continued from meeting of May 15 , 1972 , since there <br /> had been no representation on behalf of the applicant . Report provided <br /> to Council on May 12 indicated that following consideration by Planning <br /> Commission , in the absence of a majority vote for or against the applica- <br /> tion , applicant was advised a record of their proceedings would be for- <br /> , <br /> warded to Council without recommendation , and without necessity of <br /> applicant to appeal the decision , <br /> Councilman Williams indicated that in view of his prior involvement as a <br /> Planning Commissioner in earlier discussions relating to this item , and <br /> on recommendation of the City Attorney , he would abstain from participa- <br /> tion or voting in the matter . <br /> Planning Director advised that the application was a resubmission for a <br /> minor subdivision offered for consideration in 1969 , and was identical <br /> 5 /22 /72 <br />
