Way Assessment District , which sub - <br /> sequently was terminated without prejudice at a Council public hearing , <br /> Mr . Richard Gardella , attorney representing <br /> Mr . and Mrs . Miller , recalled that under the <br /> assessment proceedings , assessment of the <br /> parcel was based on seven residential units , <br /> while his clients felt that four units were <br /> acceptable . He also stated that the deed <br /> restrictions prohibited development beyond <br /> what was being proposed . He indicated they <br /> were asking approval of subdivision map con- <br /> ditioned upon standard street improvements . Sub - <br /> division of the property would also permit assess- <br /> ment of each lot , rather than the parcel as a whole . <br /> There was brief discussion relating to the single 25 -foot access for three <br /> of the parcels from unimproved street . <br /> Mr , William Holtman , 3765 Laurel Way , objected <br /> to the application for subdivision , because of <br /> increased hillside density and because he felt <br /> this would increase assessments for the neighboring <br /> properties , He also objected to the fact that ad - <br /> jacent property owners were not notified of this <br /> meeting . <br /> Mr . Gerald Martin , 315 Sussex Court , Belmont , <br /> advised he owned property in the area involved , <br /> and favored the requested subdivision . <br /> Mr . Raymond Pflug , 3769 Laurel Way , spoke against <br /> the resubdivision , and felt that since he had not <br /> been notified , the matter should be continued to <br /> allow further time to present his case . <br /> Vice -Mayor Henderson requested response from Staff regarding the matter <br /> of giving notice . City Manager pointed out the item was not a public <br /> hearing , nor was it required , and that the matter was before Council under <br /> deadlock vote of the Planning Commission as a referral by them . Councilman <br /> Rhodes inquired what the area per lot should be under sloping density pro- <br /> visions of the Ordinance . Planning Director responded that proposed Lots <br /> 3 and 4 were the steepest , with Lot 3 having a 100- foot drop . Under the <br /> Ordinance , Lot 3 would be required to have a minimum of 54 , 000 sq , ft . <br /> (proposed : 22 , 300 sq . ft . ) : Lot 4 , a minimum of 51 , 000 sq . ft . (proposed : <br /> 20 , 000 sq . ft . ) ; and Lot 2 , a minimum of 22 , 000 sq . ft , (proposed : l6 , 500 <br /> sq . ft . ) ; Lot 1 conforms to the Ordinance . Basis for these lot sizes , <br /> particularly where the terrain is very steep , is that it is undevelopable <br /> in the traditional sense , Planning Director noted that this is where the <br /> Planned Development provides a developer the opportunity to build more <br /> than a single family residence . He added that under Planned Development <br /> Permit , whatever is proposed would have to be carefully scrutinized and <br /> would include soils reports , so that there would be definite assurance <br /> that the physical structure of the land would support the development . <br /> Mr . Ben Hatfield , 1. 025 Jones Court , Owner <br /> of a lot in the Laurel Way area , indicated <br /> he would like to see Laurel Way improved , <br /> and felt that the subdivision into four <br /> lots was proper . <br /> Mr . Morris Montandon , 20916 Alves Drive , <br /> Cupertino , spoke in favor of the application <br /> for subdivision . <br /> 5 /22 /72 <br />
