( Councilman Weymouth pointed out <br /> that the seven referred to concerned hous - <br /> ing unit , not lots . ) <br /> City Manager indicated that clarification of the issue before Council <br /> was necessary at this point . He noted that the City had no interest <br /> in the public improvements in that area , and this was a decision of <br /> the property owners to make . The matter to be considered was a basic <br /> land use decision , He noted that the street and the lots were sub - <br /> standard as a result of subdivision approved many years before by the <br /> - County . He referred to a portion of the Planning Commission minutes <br /> wherein Commissioner Floyd had requested a paragraph from the Planning <br /> Staff Report be read into the record , which he then read in full , <br /> Councilman Norris moved to DENY the application of Henry and Angela M . <br /> Miller to subdivide one parcel into four parcels , and asked that the <br /> statement referred to be entered into the minutes : <br /> "The proposed subdivision violates the Zoning Ordinance <br /> and Subdivision Regulations in respect to access , street <br /> frontage , and minimum lot size . Two lots would have no <br /> public street frontage at all where the Subdivision <br /> Regulations require direct public street access . One <br /> lot would have 25 feet of frontage where the minimum <br /> lot frontage requirement of the Subdivision Regulations <br /> is 50 feet . According to the Zoning Ordinance , any <br /> residential frontage of less than 50 feet could provide <br /> access to only one single -family dwelling , although <br /> this proposal would have three lots dependent on this <br /> one lot ' s substandard access , " <br /> Motion was seconded by Councilman Rhodes , <br /> Mr . Gardella again commented that the deed <br /> restrictions permit only one single -family <br /> dwelling per lot , and stated that there was no way <br /> a cluster development could be built . He felt <br /> this term was synonymous with condominiums , apart - <br /> ments and the like , and did not feel this was <br /> desirable for the Emerald Lakes area . <br /> City Attorney noted two elements were involved : Action by the Planning <br /> Commission on the application for subdivision , and also a second , but <br /> concomitant negative vote by the Planning Commission with respect to <br /> exceptions , <br /> At his suggestion , Councilman Norris restated the motion to DENY the application <br /> for exceptions , and to disapprove the subdivision , seconded by Councilman <br /> Rhodes and carried on roll call vote , Councilman Williams abstaining , and <br /> Mayor Keckley being noted absent .
