(MINUTE ORDER #71-89) City Attorney noted that presumably the exhibits submitted tonight to Council would be presented as evidence and advised the proponents be prepared to bring them at the time of the meeting . Mr . Coleman Johnson, President , Leslie Properties , and Mr . Bob Norris , 470 Neptune Drive , each agreed to make copies available to the other of their exhibits . Resolution of Intention to vacate sewer and drainage easement had been adopted by Council on April 26 , 1971 , setting public hearing for this date . There being no communica- tions or discussion , the public hearing was closed on motion of Councilman Rhodes , seconded by Councilman Keckley and carried . Councilman Rhodes moved to adopt RESOLUTION NO . 6505 VACATING AND ABANDONING EASEMENT FOR SEWER AND DRAINAGE PURPOSES IN LOT 12 , BLOCK 204 , "HIGHLANDS OF EMERALD LAKE - SUBDIVISION TWO " , seconded by Councilman Keckley and carried on roll call vote . Request of ANDMAT COMPANY for City ' s consent for the annexation of Lot 10 and portion of Lot 11 , Block 23 , Oak Knoll Manor Subdivision to the Oak Knoll Sewer Maintenance District . Mr . Vernon Harris , 16 Canyon Oak Drive , San Rafael , attorney representing the applicant , advised he would be available to respond in the event Council had questions . In the discussion , it was determined that the number of lots to be served would be five or fewer . City Attorney added that technically , the number of lots is not limited , but the resolution would restrict the number of sewer connections . It did not specify that the dwellings would be single -family , and applicant was invited to amplify . Mr . Harris indicated it was his understanding the area was zoned by the County for single - family . City Manager pro tem confirmed this , and advised that nothing else could be developed on this property without a zoning change .
