5 <br /> Councilman Henderson stated that one of her concerns had been the number of <br /> areas that may have to be built up that were not included in the feasibility <br /> report and whether or not this would impair the economic feasibility of the <br /> project , and whether or not bond funds were sufficient to meet the expense . <br /> Mr . Reiter responded that there was sufficient money , that the degree of <br /> capital expenditures required was relatively insignificant and would have <br /> no effect on the feasibility . <br /> Mayor Bury stated that the question of ground water withdrawal came up largely <br /> as a result of questioning by Congressman McCloskey relating to agricultural areas <br /> on the east side of the Bay and in the South Bay area . This is a matter that <br /> is regulated by statutes that presently give the authority to county , state and <br /> city to respond when excesses of withdrawals would cause subsidence or settling <br /> at the surface level . City had stated they would make sure in the event such <br /> an occurrence took place that the provisions of present law were applied and <br /> enforced to cause the conditions to be corrected . These statutes preempt City <br /> from making any direct decisions . <br /> City Attorney stated that this type of water knows no boundaries and that State <br /> statutes are more directly in point as far as regulation of ground water with- <br /> drawal is concerned . <br /> Mayor Bury pointed out that there is no demand of this type of technique of <br /> removing water in this area . More directly concerned are the agriculatural <br /> areas . There could be an effect raised by some far distant use , at which <br /> time City would respond . He also stated that this falls in the category of <br /> many items on which Council takes no direct action as to policy but is involved <br /> in regulatory measures that are in effect . <br /> City Attorney stated there is one area under the provisions of the Health and <br /> Safety Code having to do with City acting as a public utility and furnishing <br /> fresh water in which City is prohibited from allowing well drilling in areas <br /> from which fresh water is furnished . There is an overseeing State agency <br /> regulating the drilling of wells in back yards , in conjunction with City ' s <br /> permits to furnish fresh water . <br /> City Manager stated that the latest USGS map indicates that the subsidence <br /> from ground water withdrawal in this general area in the recent past ( 10 to <br /> 20 years ) has been negligible . In this immediate area , the last commercial <br /> user of ground water will soon be phased out . City has requested the Seismic <br /> Advisory Board to look into the matter concerning ground water . The Board ' s <br /> findings will be contained in their " five -year update " , the draft of which <br /> will be out about the end of March . <br />
