412 ACCEPTANCE of Project , Municipal Services Center . Project had been inspected by DMJM , as City ' s architects , and by City Staff , and acceptance was recommended , subject to the usual guarantees of material and workmanship . Final costs of the facility were under the budget . In response to question by Mayor Bury , City Attorney advised that there is no contractual relationship with any subcontractors , and action by Council would make no representation to parties other than the general contractor . He stated the City retains 10% of the contract price for a period of 35 days , and that there are no hold notices , Councilman Weymouth moved to accept the Municipal Services Center Project , subject to the usual one -year guarantee of workmanship and materials , seconded by Councilman Rhodes , and carried . (MINUTE ORDER #71-33 ) Councilman Weymouth moved to adopt RESOLUTION NO , 646o APPROVING AND AUTHORIZING EXECUTION OF AGREEMENT FOR AUCTION SERVICES , seconded by Councilman Henderson . In response to question by Council , City Manager reported that this would be a joint auction with the County , and other cities may be involved . Each city would have to enter into a separate agreement with the auctioneers . The date of the auction has not been determined . Motion carried on roll call vote , Councilman Keckley and Petersen being noted absent . Councilman Weymouth moved to adopt RESOLUTION NO , 6461 FINDING AND DETERMINING THAT TEMPORARY ROADWAY EASEMENT IS NO LONGER REQUIRED FOR PUBLIC PURPOSES , AND APPROVING AND AUTHORIZING EXECUTION OF QUIT CLAIM DEED OF SAID TEMPORARY EASEMENT PURSUANT TO PRIOR AGREEMENT , seconded by Councilman Williams , and carried on roll call vote , Councilmen Keckley and Petersen being noted absent . Councilman Henderson inquired if Radio Road is still being used , or if there is another access to the developed area other than the bridge . She stressed the importance of an alternate access in case of emergency . City Manager responded that he was not sure about Radio Road , but stated that there is access to the inhabited area other than the bridge . Mayor Bury requested City Manager to include this matter in the next Community Progress Report , and also a report on the progress of the strategic - consolidation sewerage plan , which he noted was almost completed .
