1.4 PROGRAM - Includes (a) Cameras installed by the Contractor or a Subcontractor <br />selected by the Contractor, in final configuration and in full working order, including the <br />process to capture, transport and process images to the location where the citations are <br />to be produced; (b) processing of citations with needed personnel hired and processing <br />equipment in place; (c) any software needed to produce citations, track violations, issue <br />citations; production of clear, easily identifiable citations; and d)connections needed <br />with the Division of Motor Vehicles to obtain motor vehicle registration information. <br /> <br />1.4.1 Contractor designates, as its Program Manager for supervision of the tasks <br />and services required by this Agreement, the following individual: <br /> <br /> John Flynn <br /> Program Manager <br /> <br />1.5 PROCUREMENT OF EQUIPMENT - Contractor agrees to procure City-approved <br />equipment for the monitoring of a mutually agreeable number of intersections that meet <br />the criteria specified in Section 1.1. All equipment shall remain the property of the <br />Contractor. <br /> <br />1.6 MAINTENANCE - The Contractor shall maintain the Photo Red Light Enforcement <br />system and all associated equipment in good working order. Any malfunctioning <br />Camera or related equipment shall be returned to good working order within seventy <br />two (72) hours of notification that the equipment is not in proper working order. <br /> <br />1.7COLLECTIONS - The City will diligently prosecute each Citation and may defend <br />any challenge in any court of competent jurisdiction to the use of the Unit or validity of <br />its results and/or the use of the U.S. mail to deliver the Citation. City Counsel may <br />consult and confer with counsel for Contractor in any such proceeding upon reasonable <br />request for such consultation. <br /> <br />1.8 ADDITIONAL MONITORING - The Contractor may provide enforcement <br />monitoring of traffic regulations, other than red light violations, as permitted by State <br />statute and as directed by the City, at a compensation to be mutually agreed to. <br /> <br />1.9 ACCESS TO DMV - The Contractor shall access directly the driver license <br />information and the registered owner residence address from the California Department <br />of Motor Vehicle (DMV). <br /> <br />1.10 VIOLATIONS - The Contractor shall work closely with the Redwood City Police <br />Department and Municipal Court in the issuance of violations. All notices to appear <br />must be approved and signed by the Redwood City Police Department. <br />1.11 CERTIFICATE OF MAILING - The certificate of mailing, required by CVC 40518, <br />must be a certification issued by the Post Office. Copy of the certificate must be <br />provided to the Court. The Contractor must provide the Court with true and correct <br />copies of the Notices to Appear. <br /> <br /> 1.2 <br /> <br /> <br />
