Letters
in protest of the rezoning application were reported by the City Clerk as having
been received from:
Richard M. Delucchi., 3793 Woodside Road, on basis of present
availability of space for commercial use in the shopping
center as well as proposed use of property for additional
liquor store.
Marsh Manor Merchants Association, Byron Bachtel, Secretary
advised of unanimous protest of the proposed rezoning application,
Staff
Staff report indicated that Planning Commission had voted on April 28, 1970,
following a public hearing, to deny the application by a vote of 3 to 2 (two
Commissioners absent).
Mr. 0. W. Osteen, 3552 Spring Street, requested clarification
as to whether requested rezoning would permit at some future
time use for on-site liquor sales.
City Attorney responded that "CN" zoning does not permit on-site sale of liquor.
He cited various types of establishments that are permitted, including liquor
stores, which are permitted under the "CN" designation, but subject first to
obtaining a Use Permit.
