<br />Invocation led by Reverend Donald J. Cunningham, Woodside Road Community Methodist
<br />Church,
<br />ON ROLL CALL the following were noted present: Councilmen Mary W. Henderson,
<br />Paul C. Keckley, Herbert G. Petersen, John S. Rosselli, Ray A. Weymouth, Mayor
<br />Robert H. Bury, and Deputy City Clerk Marian McCrindle. Noted absent was
<br />Councilman Dixon Arnett. Also noted present were City Manager Howard C.
<br />Ullrich, City Attorney David E. Schricker, Assistant City Manager Henry V.
<br />Burget, Fire Chief Joseph Lodi, Police Chief John R. McDonald,Jr., Director
<br />of Public Works J. Louis Scherer, Planning Director Ken Schroeter, Chief Build-
<br />ing Official Charles Gyselbrecht, Personnel Director Alfred Wiers, and Secretary
<br />Frances Ozzanto.

<br />Petersen moved to approve minutes
<br />of the Regular
<br />Meeting of January
<br />19, 1970,
<br />as mailed, seconded by Councilman
<br />Henderson and
<br />carried.
<br />Retiring Reserve Police Officer Charles Zimmerman was presented with a copy
<br />of Resolution No. 6195 and his badge mounted on a plaque, on the occasion of
<br />his retirement, by Mayor Bury and Police Chief with expressions of appreciation
<br />for his services.
<br />Loyalty Oaths were administered by the Deputy City Clerk and Certificates of
<br />Appointment presented by Mayor Bury to Walter G. Small and Edward J. Voss,
<br />reappointed as Members of the Personnel Board for a term of six years (to
<br />January, 1976).
<br />Association of Bay Area Governments - Election of President and Vice President,
<br />Each Council Member was handed an official ballot, votes were cast and returned
<br />to the Deputy City Clerk in sealed identification envelopes, which are then to
<br />be returned to the Executive Director of ABAG by the Clerk, as instructed in the
<br />Association's Rules and Procedures. Councilman Henderson stated she had been
<br />asked to be ;y(nember of ABAG board for canvassing votes.
<br />APPEAL OF Mr. and Mrs. Charles Durkee from action by the Planning Commission at
<br />its meeting of January 13, 1970, to "terminate without prejudice" their Application
<br />for a Variance to Section 4.9(c), Ordinance No. 1130, property located at 3762
<br />Laurel Way, being Lot 11, Block 8, Highlands of Emerald Lake, Subdivision 1, in
<br />an "RH" District.
<br />Councilman Rosselli moved to affirm the action of the Planning Commission,
<br />seconded by Councilman Petersen. Additional information was requested by
<br />Council and it was suggested by Staff that the Appellant might wish to comment.
<br />Charles Durkee, 74 Orchard Avenue, felt that
<br />a point of interest that might influence Council
<br />to override the "termination" was the fact that
<br />he had not been notified of the Planning Commission
<br />meeting at which their action was taken. Also,
<br />that residents of the area concerned had been
<br />notified by the Director of Public Works of a
<br />meeting to be held relative to assessment district
<br />plans, and felt Planning Commission decision should
<br />have been held in abeyance until after that meeting.
<br />He asked that the matter be tabled for two or three
<br />weeks, repeating they had no notification of the
<br />meeting, and there was an investment involved.
