Relative to the matter of the apparent failure to notify the <br />affected owners, it was stated that published notice is required within 300' of the <br />territory involved for zoning hearings, and presumably tenants are included, as well. <br />However, failure to notify is not deemed to invalidate the proceedings. Mailing <br />lists for public hearings are provided to the Clerk by the Planning Department, <br />Vice Mayor Petersen called for any additional persons interested in the matter who <br />had not been notified, and Mr. Stanley Unger, 1325 Edgewood, responded that he also <br />had not received notice. <br />City Attorney offered the opinion that, since Council has been presented with evidence <br />that appropriate notice had not been provided, it would probably be in the best <br />interest to continue the hearing under the circumstances, notwithstanding any tech- <br />nical legal requirements. <br />Councilman Henderson moved to continue the hearing for two weeks, to January 19, 1970, <br />and to direct reissuance of notices, seconded by Councilman Keckley and carried. <br />(MINUTE ORDER # 70-1) <br />Kenneth Helms, Minister, Unitarian Fellowship <br />of Redwood City, 2124 Brewster, addressed the Council <br />relative to concerned citizens for a public discussion <br />of the recent police incident and petitions that had <br />been submitted requesting review of police policies. <br />Vice Mayor Petersen stated that the matter was not on the agenda and would not be <br />discussed at this meeting; that Mayor Bury had responded individually to each letter <br />pertaining to the matter, and had indicated that he was willing to meet with anyone <br />wishing to discuss the case. Council indicated it would be improper to proceed with <br />a full-fledged discussion without appropriate notice. It was also felt that the <br />Mayor should have the opportunity to be present, and also that the fact the case is <br />pending in the courts must be considered and City Attorney's advice sought before <br />Council could proceed to discuss this matter further. <br />PUBLIC HEARING, Application of LESLIE PROPERTIES, INC., to amend the Zoning Map to <br />rezone property in Redwood Peninsula, being an area bounded by Peninsula Parkway, <br />Shell Boulevard, PG&E high tension lines, and controlled waterway system, from "TP" <br />(Tidal Plain) District to "R -1-P" (Single Family Residential -Planned Development <br />Combining), "R-4" (Multi -Family -Medium Density), and "CN" (Neighborhood Commercial <br />District), declared open and affidavits of publication and mailing ordered filed. <br />Staff report was read, stating that4he proposed zoning districts relate to recently <br />approved Tentative Map of Steinberger Subdivision. The proposed "R -I -P" District, <br />covering approximately one-half of the subdivision area, had tentatively been <br />subdivided into traditional single family lots plus a proposed elementary school, <br />junior high school, and park. Three areas are proposed for "R -2-P" zoning, and may <br />be further subdivided at a future time. Two island areas are proposed for "R-4" <br />zoning, where garden apartments are proposed.
