139 <br />Mayor Bury called a five minute recess at 10:45 P,M, <br />Planning Director defended the proposal, noting that it would not be restrictive <br />enough for some peninsula communities, but felt that the main factor to be con- <br />sidered is the City's objectives, When those are determined, then the ordinance <br />should reflect that decision; however, he felt it should be recognized what the im- <br />pact will be. He noted the 100% approval of the Citizens Advisory Committee, <br />Bruce Wyckoff, 1215 Chesterton, responded to various state- <br />ments made, and acknowledgeiit is possible to have inferior <br />development under the ordinance, and that in his field calls <br />relative to work on the Planning Commission had seen ex- <br />amples of what should not be permitted. Commenting on pleas <br />of hardship, he indicated that allowing overbuilding damages <br />the surrounding community; therefore, for the maximum good of <br />the City, a better ordinance is needed, <br />William Oeser, 634 Emerald Hill Road, stated he did not like <br />what he saw on walking tour, but thought the present ordinance <br />hadn't had the opportunity to be tried yet, He felt the <br />ordinance should not be amended, <br />There being no further communications or oral protest, Councilman Petersen moved to <br />close the public hearing, seconded by Councilman Rosselli and carried, <br />Councilman Henderson moved to introduce ordinance amending sections of Ordinance No. 1130, <br />relating to lot area requirements per family unit, modifications to lot area re- <br />quirements per family unit, and supplementary yard and open space requirements, <br />respectively, for designated zoning districts, seconded by Councilman Arnett. Council- <br />man Henderson stated her support of the ordinance, indicating that decisions made 4 <br />years ago do not meet requirements any more, and that the ordinance does head in the <br />right direction in being responsive to problems that have existed, Councilman Arnett <br />stated he accepted the fact that requirement of Use Permit would be an inconvenience, <br />but the question was whether to establish the mechanics for upgrading standards of <br />living environment. The proposed ordinance attempts to provide the legislative tool <br />by which this can be accomplished. Councilman Keckley indicated that adding the stig- <br />ma of a Use Permit will do nothing to encourage building, which he felt should be made <br />as easy as possible, and that the amendments do not provide the solution he considered <br />best for the City, <br />Councilman Petersen also spoke against the amendment, indicating he felt this was one <br />of the most rational and fact-finding public hearings presented in offering persuasive <br />arguments against the amendments, Motion to introduce the ordinance failed on roll <br />call vote, Councilmen Arnett, Henderson and Mayor Bury voting yes, and Councilmen <br />Keckley, Petersen, Rosselli and Weymouth voting no, <br />On recommendation of City Attorney, motion to terminate the proceedings was made by Council- <br />man Rosselli, seconded by Councilman Keckley, Councilman Henderson questioned legal <br />ramifications of termination of proceedings, as to restrictions against re-examination <br />by the Planning Commission, and was advised by the City Attorney there were none, <br />Motion carried, (MINUTE ORDER #70-49) <br />
