3 '76 6 <br /> appointment to the Planning Commission , it would be necessary for the Nominating Com- <br /> mittee to make another appointment . <br /> Legislative Committee Report submitted previously to Council for review covered the follow - <br /> ing proposed bills as summarized : <br /> A .B . 684 proposing the PUC shall have jurisdiction to determine whether <br /> specified deliveries by carriers are occasional and incidental to busi - <br /> ness conducted elsewhere ; S . B . 648 would declare that the service performed <br /> by highways carriers is a matter off` State -wide concern and would prohibit <br /> the levy of any excise or license tax by a city , county , or city and county . <br /> Recommended for opposing as the two bills would operate to eliminate a local <br /> source of municipal revenue , and without justification , place under state con - <br /> trol a particular segment of commerce . <br /> A .B . 773 proposing that the money in the State Highway Fund be allocated so <br /> that-475 thereof would go to northern counties and 57% to southern counties <br /> ( as opposed to 45%-55% , respectively ) . Recommended for opposition ( as in <br /> case of S .B . 33 and S .B . 73 previously recommended for opposition ) <br /> A .B . 908 proposing to increase the public employers ' contribution to the <br /> retirement fund by an unspecified amount with respect to law enforcement <br /> members , in addition to increasing the amounts of retirement benefits to <br /> law enforcement personnel , thus discriminating without justification in favor <br /> of one group of employees . Committee recommends opposition . <br /> A .B . 977 proposing amendment to the Labor Code specifying that the statutory <br /> provisions relating to workmens ' compensation and insurance and safety in employ- <br /> ment shall be construed by the courts with equal regard to employee and employer . <br /> Committee recommends approval as believe would reduce the number of claims filed <br /> under the workmens ' compensation provisions . <br /> A .B . 1242 would amend certain sections of the Revenue and Taxation Code to pro - <br /> vide that the property tax exemption of property used exclusively for religious , <br /> hospital , scientific , or charitable purposes not be applied to property used for <br /> profit by taxpayers claiming such exemptions . Recommended for approval as believed <br /> would plug a tax " loophole " where the subject excemptions are being abused . <br /> A .B . 1400 would require compulsory arbitration between public agencies ( excluding <br /> the State ) and organizations representing full time peace officers or fire fighters <br /> concerning disputes relating to working conditions . Committee recommends opposition <br /> as contrary to the rule that personnel matters are of local -concern . <br /> A .B . 1481 would allow the insertion of compulsory arbitration provisions in <br /> contracts for construction to which the State or any political subdivision <br /> thereof is a party . Committee recommends opposition as would not be in the <br /> best interest of the City and would hamper City ' s freedom to contract . <br /> S .B . 538 would delete the provision of the Brown Act requiring that a member of <br /> the legislative body of a local agency attending an illegal meeting must have <br /> knowledge that such meeting is illegal in order for conviction of the crime of <br /> attending such meeting . Committee recommends opposition as Committee believes <br /> could well serve as a trap to unsuspecting and innocent parties . <br /> S .B . 553 would require that cities and counties deposit into special gas tax <br /> street improvement funds the interest received from investment of money in such <br /> funds . Committee recommends opposition in order that local agencies may determine <br /> in accordance with their own best interests . <br /> ( For full text see City Clerk ' s file - Legislative Committee ) <br /> Councilman Henderson noted another report would be made next meeting . Councilman Keckley <br /> moved to accept the Legislative Committee report and recommendations , seconded by Councilman <br /> Petersen and carried ( MINUTE ORDER #69 - 123 ) <br /> Adoption of Ordinance rezoning property in the vicinity of Uccelli Boulevard and Bair Island <br /> Road , introduced at Council meeting of June 9th , continued for one week as requested by <br /> City Manager , on motion of Councilman Weymouth , seconded by Councilman Keckley , <br /> City Manager reported since introduction of the ordinance rezoning this property , violations <br /> of the non -access strip and existing zoning had been noted . He advised the occupant had <br /> been directed to remove the materials placed on this property as rea) ning not even in <br /> effect nor access permissible . He requested that no further action be taken to adopt the <br /> ordinance at this point , until violations have been corrected .
