5 <br /> advised it was necessary for Council at this time to carry out the same intent of <br /> the Engineer ' s plans as presented at the time of the bond issue ; however , since <br /> that plan was stated in somewhat general terms , good engineering practice would <br /> follow to finalize plans at later stages when reviewing specific portions of the <br /> creek , to make final specific recommendations , and if found not necessary to include <br /> a portion of the creek for any type of improvement , then Council may exempt a <br /> portion because not in plan to begin with . <br /> In reply to question as to whether if this portion exempted from improvements at <br /> this time , and it was subsequently determined through experience improvements needed , <br /> would Council be precluded from making improvement of any kind , City Attorney ad - <br /> vised Council may always , on evaluation of facts on later information , make a <br /> determination to construct public improvements for sake of public improvements <br /> for sake of public safety and welfare . City Attorney advised further a determination <br /> would have to be made at this time on basis of need , not on basis of preserving <br /> landscaping , or whether majority of property owners for or against improvements , <br /> as to do so would be in effect ignoring responsibility of public improvement re - <br /> lating to needs of entire City and District . <br /> The following appeared : <br /> Tom Hattie , 2720 Kensington Road , indicated need of improvements <br /> from Alameda to Maddux . <br /> City Manager stated it would be his recommendation that Council authorize Staff to <br /> proceed with preparation of preliminary engineering drawings for this specific <br /> portion of creek, directing efforts to containing flood waters by way of piping , if <br /> feasible . <br /> I <br /> Mayor Bury noted that several references had been made to debris which had been <br /> dumped in creek areas , causing jams and flooding . <br /> Mr . Batsford advised work to reach point of a recommendation <br /> requires field survey in creek areas which would probably take <br /> two weeks , and thereafter two months before all data would be <br /> available in order to make a report and recommendation for best <br /> solution from an engineering and economic standpoint . <br /> Dr . Robert Dorin , 1563 Granger Way , reported there had been <br /> no problems with creek in area adjacent to his property for past <br /> fifteen years , as this section not faced with same problems as <br /> that below and felt improvements should not be made in this section , <br /> Councilman Henderson noted that she had seen evidence of bank erosion on some of <br /> the properties in this section , as she was a neighbor to Dr . Dorin , and partially <br /> why she felt potential of piping must be examined for this section . Since it had <br /> been also stated property owners had not been individually notified of hearings <br /> in this section , City Manager agreed it would be possible when plans and specifications <br /> have been prepared indicating type of improvements needed , that property owners <br /> could be notified prior to Council approval . <br /> Mrs . Helen Danielson , 27 .8 Carolina , stated no questionnaire as <br /> mentioned by the Director of Public Works had been received by <br /> her .
