require OCS poles on either side of the tracks every 180 to 200 feet to hang an <br />overhead power system above each track. At this time approximately ten OCS poles <br />are anticipated to be within City right-of-way. Although the exact location of these poles <br />is tentative and subject to change, the proposed agreement provides a mechanism for <br />the City and JPB to cooperate in finding locations that work for both parties. <br /> <br />Occasional traffic control and temporary street closures are anticipated due to the work. <br />In order to maintain weekday commuter service much of the work will take place during <br />nights and weekends, with adequate noticing provided to the City and residents. <br />Construction is estimated to begin as soon as 2017, and the first electric trains are <br />anticipated to arrive in 2020. <br /> <br />ALTERNATIVES <br />City Council may choose not to approve the agreement or direct staff to modify the <br />terms of the agreement, in which case the JPB will not be committed to the same level <br />of cooperation provided by the proposed agreement. <br /> <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br /> <br />ENVIRONMENTAL REVIEW <br />Entering into this agreement is not a project under CEQA as defined in CEQA <br />Guidelines, Section 15378, because it has no potential for resulting in either a direct or <br />foreseeable physical change in the environment. <br /> <br />The JPB is the lead agency under CEQA for PCEP. On January 8, 2015, pursuant to <br />Resolution No. 2015-03 and No. 2015-04, the JPB certified conformance with the <br />California Environmental Quality Act (CEQA) to the extent that it is applicable to PCEP, <br />certified the Final Environmental Impact Report (FEIR), adopted CEQA findings of fact, <br />adopted a statement of overriding considerations, and adopted a mitigation monitoring <br />and reporting plan. <br /> <br />Depending on the exact scope of work it is possible that the City will be a Responsible <br />Agency under CEQA, in which case the City and/or its staff would issue the necessary <br />discretionary approvals in accordance with CEQA Guidelines. <br /> <br />KEVIN FEHR <br />SENIOR CIVIL ENGINEER <br />6.1.A. - Page 2
