FIRST AMENDMENT TO <br /> CITY CENTER PLAZA <br /> DECLARATION ESTABLISHING RECIPROCAL EASEMENTS AND <br /> COVENANTS RUNNING WITH THE LAND <br /> This First Amendment is made and entered into this 5th day of June, 2012 by and between <br /> Mezes Court Associates , a California Limited Partnership ("Mezes" or "Residential Owner") <br /> and Helen Raiser as Trustee of the J.H.R. Trust, under Trust Agreement dated October 2, 1969, as <br /> amended, ("Raiser" or "Commercial Owner") bears the following recitals: <br /> A. On or about June 18, 1996, Mezes and J.H.R. Trust entered into that certain City <br /> Center Plaza Declaration Establishing Reciprocal Easements and Covenants Running with the <br /> Land (the "REA"). <br /> B. The parties hereto now desire to amend the REA as hereinafter set forth. <br /> NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS, <br /> PROMISES, REPRESENTATIONS SET FORTH HEREIN AND OTHER GOOD AND <br /> VALUABLE CONSIDERATION, THE RECEIPT, SUFFICIENCY AND EXCHANGE OF <br /> WHICH IS HEREBY ACKNOWLEDGED THE PARTIES, INTENDING TO BE LEGALLY <br /> BOUND AGREE AS FOLLOWS: <br /> 1 . The following sentence is hereby added to recital B: <br /> "Without amending or altering the legal description or definition of the Parcels <br /> and Lots it is understood for purposes of this REA that Lot 3 includes that portion of the <br /> ■ <br /> Improvements that are over and above the first floor level Commercial Parcel in which Raiser's <br /> tenants are located, and that those portions of Lot 3 that overhang the Commercial Parcel are <br /> included within and are a part of the Residential Parcel owned by Mezes." <br /> 2 <br />
