Step four – Lien sale auction: The City advertises an auction in the newspaper within 30 days of the auction and no later than 10 days before the auction. The City also notifies the current registered owner of the vessel of the auction date. Step five – Donation: If the auction is unsuccessful, the City will attempt to donate the vessel to a charitable organization if the vessel is deemed to be in good enough condition for the organization to accept. Step six – Demolition and Removal: The City will remove and demolish vessels that cannot be sold or donated. Any hazardous materials will be safely removed and properly disposed of. The City may also engage a third party to remove and demolish vessels. Abandoned Vessels An abandoned vessel is a vessel left in Docktown slip in which the City does not have a lease agreement or an unidentified vessel left in the waterway adjacent to the marina. Step one – Serve a three day “Notice to Quit.” Step two – Tow to wet storage if an owner does not come forward. Step three – Conduct a DMV owner search. Step four – If no owner is identified, the City issues a 30-day hold. Step five – Demolition and Removal: The City will remove and demolish vessels that cannot be sold or donated. Agency prevention efforts of abandoned vessels The City’s abandoned vessel prevention efforts include notifying vessels which do not have a lease agreement that they are trespassing. Also performing the adjudication process for non-paying vessels, or evicting non-paying tenants and taking ownership of the vessels. Upon being accepted into the vessel turn in program the City plans to send notice to all tenants currently occupying Docktown Marina, of the City’s willingness to take on the removal responsibility of any unwanted vessels. 5. Application Questionnaire 1. Does your agency have an active local enforcement program tasked with addressing abandoned vessels in your jurisdiction? Yes No If yes, explain in detail. If no, elaborate on your agency’s efforts to create a program or if you utilize enforcement services from another agency and how. Although the City of Redwood City's PD does not have dedicated staff tasked with identifying and addressing abandon vessels, Public Works manages the marina and has staff onsite, who coordinate with PD when appropriate. Public Works collaborates with the City Attorney's Office, PD, and the Office of the City manager when there is a suspected abandoned vessel. When this occurs The City makes every effort to locate the vessel's owner and begin an adjudication process if necessary. 2. Does your agency have a submerged navigational hazard abatement plan (SNHAP)? This may include: 1) An established internal process outlining procedures to prevent, mitigate and process abandoned vessels; 2) Bylaws, regulations, or ordinances that help prevent or mitigate abandoned vessels. If No, explain your agency’s efforts to create a SNHAP and anticipated date of effect. With the passing of the Marine Debris Statute, creating Harbors and Navigation Code (HNC) Sections 550 and 551, the City anticipates working with the Port of Redwood City to evaluate the potential for developing a SNHAP, potentially using the attached SNHAP from Contra Costa County Office of the Sheriff as a model. 6.1.M. - Page 32
