and cleanliness of the playground but engages the users of the playground to facilitate <br />inclusiveness and programming. The fees associated with the rights to design, <br />fundraising, and community engagement includes four milestone payments (approval of <br />agreement; design completion; fundraising goal completion, and project completion), in <br />the total amount of $275,000; and a $20,000 quarterly payment for Foundation staff <br />time up to a six quarters with a total not to exceed amount of $395,000. This figure is <br />included in the total of City contribution of $1.5 million towards the overall Project. <br /> <br />ALTERNATIVES <br />Council may elect not to authorize the City Manager to execute the agreement. <br /> <br />FISCAL IMPACT <br />City Council has appropriated a total of $2.1 million towards the Red Morton Park <br />(Westside) master planning and playground/picnic area renovation project. The City’s <br />recommended commitment towards the Magical Bridge Playground is $1.5 million and <br />includes fee for services to Magical Bridge Foundation in the amount not to exceed <br />$395,000. The Magical Bridge Foundation would be responsible for raising $1.8 million <br />towards the Project as described in the partnership agreement. <br /> <br />ENVIRONMENTAL REVIEW <br />This agreement is not a project under CEQA as defined in CEQA Guidelines, section <br />15378, because the agreement itself has no potential for resulting in either a direct or <br />foreseeable physical change in the environment.
