2 <br />representatives of OPC will then seek to meet with individuals to discuss specific assistance for <br />which they qualify and help them through the relocation process. <br />In order to understand the needs and interests of individuals living at Docktown and to develop a <br />proposed Docktown Plan for the City Council’s consideration, the City issued a Request for <br />Proposals (RFP) to retain a qualified consultant who will be responsible for providing all services <br />necessary to prepare a Docktown Plan and implement relocation services once the City Council <br />adopts a Docktown Plan. The scope of work is set forth in two phases: 1) Preparation of a <br />Docktown Plan for City Council action by the end of 2016; and, 2) Implementation of the adopted <br />Plan for the relocation of all of the vessels beginning in 2017. <br /> <br />Four experienced Bay Area relocation firms responded to the RFP. Staff evaluated the proposals <br />on the basis of comparable experience, proposed cost, staffing depth of the firm, and prior <br />experience with the firm. The evaluation committee interviewed two of the four firms and one firm, <br />Overland, Pacific and Cutler (OPC), was clearly the best fit and most qualified. Over the last 36 <br />years, OPC has assisted numerous public agencies and private entities, handling more than <br />40,000 residential, commercial, and industrial relocation cases. OPC has provided relocation <br />services directly to, and in collaboration with, cities throughout California, including the cities of <br />East Palo Alto, San Carlos and South San Francisco, as well as the San Mateo County Housing <br />Authority. In addition, OPC has worked with cities in Santa Clara County, including Mountain <br />View, Palo Alto, San Jose, and Sunnyvale. <br /> <br />In order to meet the City's commitment to adopt a Docktown Plan by December 31, 2016, it was <br />necessary to authorize the relocation consultant to immediately prepare the initial cost estimates <br />for the project. An initial contract not to exceed $60,000 with OPC was approved by the acting <br />City Attorney (Burke, Williams and Sorensen) to gather preliminary data. At this time, staff <br />recommends that the City Council approve a contract with OPC to provide for the full scope of <br />services required for the preparation of the Plan and provision of relocation assistance beginning <br />in 2017 (see Attachment B). <br /> <br />History of Docktown Marina <br /> <br />Since 1954, the City of Redwood City has served as a trustee for the land on which the Docktown <br />Marina is located. This only includes the land under the creek, not the land-based property <br />adjacent to the creek which the City leases from a private owner. In this role, the City owns the <br />creek area on behalf of the citizens of California and as a consequence must ensure that the land <br />is used in accordance with the statutes that granted the land to the City as well as with the <br />California Constitution, applicable case law, and the common law Public Trust Doctrine. <br /> <br />The Docktown Marina has existed since the 1960s. In 1983, the City issued a revocable permit <br />with a marina operator, Fred Earnhardt, who also had a lease agreement with the landside <br />property owners. When Mr. Earnhardt advised the City of his intention to terminate the permit, the <br />City agreed to assume the operations and management of Docktown to avoid immediate <br />relocation of Docktown community members. Since 2013, the City has operated Docktown <br />Marina. There are approximately 95 occupied berths within the Marina, of which 71 have <br />residential tenants (see Attachment A). Whether operated by a private operator or the City, <br />people living at Docktown have always participated in short-term rental arrangements. <br /> <br />The State Lands Commission has made clear that the City can no longer permit private <br />residential uses at Docktown.
