<br /> as a resl:'lt of misuse or neglect by Tenant), then Tenant's Base Rent and Additional Rent <br /> shall be abated from and after such fifth (5th) day until such services are restored. In such <br /> a case, Landlord agrees to use its best efforts to restore the interrupted services as soon <br /> as reasonably possible. <br /> 3.4 Tenant's Care of the Premises. <br /> Except for customary cleaning and trash removal provided by Landlord under <br /> Section 3.3 and damage covered under Article 6, Tenant shall keep the Premises in good <br /> and sanitary condition, working order, and repair (including, without limitation, carpet, wall- <br /> covering, doors, plumbing, and other fixtures, equipment, alterations, and improvements, <br /> whether installed by Landlord or Tenant), ordinary wear and tear excepted. In the event <br /> that any repairs, maintenance, or replacements are required, Tenant shall promptly <br /> arrange for the same either through Landlord for such reasonable charges as Landlord <br /> may from time to time establish, or such contractors as Landlord generally uses at the <br /> Property, or such other contractors as Landlord shall first approve in writing, and complete <br /> the same in a first-class, workmanlike manner. If Tenant does not promptly make such <br /> arrangements, Landlord may, but need not, make such repairs, maintenance, and <br /> replacements, and the costs paid or incurred by Landlord therefor shall be reimbursed by <br /> Tenant promptly after request by Landlord. Tenant shall indemnify Landlord and pay for <br /> any repairs, maintenance, and replacements to areas of the Property outside the premises <br /> actually caused, in whole or in part, as a result of Tenants moving any furniture, fixtures, <br /> or other property to or from the Premises, or by Tenant or its employees, agents, <br /> contractors or visitors. <br /> 3.5 Landlord's Repairs. <br /> Except as provided in Section 3.4 or for damage covered under Article 6, <br /> Landlord shall keep the common areas of the Property in good and sanitary condition, <br /> working order, and repair. The cost of Landlord's repairs hereunder shall be included in <br /> Operating Expenses, as described in Section 2.3.6, except as limited therein. <br /> 3.6 Waiver by Tenant. <br /> Tenant expressly waives the benefits of any statute now or hereafter in effect <br /> which would otherwise afford Tenant the right to make repairs at Landlord's expense or to <br /> terminate this Lease because of Landlord's failure to keep the Premises in good order, <br /> condition, and repair. <br /> 18 <br /> . .. ~'.~ ..m~ <br /> T T" T -. <br />
