FINDINGS ON APPEAL OF ZONING ADMINISTRATOR'S DENIAL OF AN APPLICATION OF <br />ARCHITECTURAL PERMIT TO ALLOW CONVERSION OF AN EXISTING DWELLING TO A <br />COMMERCIAL OFFICE IN CONJUNCTION WITH A TWELVE- SCREEN THEATRE, 555 EAST <br />BAYSHORE ROAD <br />Hearing having been duly noticed and held by this Council, on the appeal of <br />Syufy Enterprises ( "Appellant ") of the decision of the Zoning Administrator <br />to deny Appellant's application for an Architectural Permit to allow the <br />conversion of an existing dwelling to a commercial office in conjunction <br />with a twelve screen theatre, at 555 East Bayshore Road, Redwood City, <br />California ( "Subject Property "), the Appellant, the Zoning Administrator, <br />and all other persons having been heard and having been given the <br />opportunity to be heard, and this Council having fully considered the <br />matter. <br />NOW, THEREFORE, this Council finds, determines and concludes as follows: <br />FINDINGS <br />1. The Subject Property is located at 555 East Bayshore Road in Redwood <br />City, California. <br />2. Appellant filed an application for an Architectural Permit to convert an <br />existing dwelling on the Subject Property into a two -unit office building on <br />May 15, 1990. <br />3. The Zoning Administrator denied the application for an Architectural <br />Permit on July 16, 1990. <br />4. Despite several requests by the Zoning Administrator, Appellant has <br />failed to submit a clear, complete, and understandable set of drawings <br />related to the project to the City, as required for an Architectural Permit <br />by Section 45.5 of the City's Zoning Ordinance. <br />5. The existing residential structure, which is located between two <br />virtually new buildings, and is not compatible with the design of the new <br />theatre complex, is not consistent with the surrounding area. <br />Section 45.8c of the Zoning Ordinance provides that in granting, <br />denying, or conditionally granting an application for an Architectural <br />Permit, the Zoning Administrator must base his /her decision on factors <br />including: <br />"The extent to which the structure conforms to the general character of <br />other structures in the vicinity insofar as the character can be <br />ascertained and is found to be architecturally desirable." <br />6. The addition of this building in this location is in violation of the <br />Use Permit granted by the City Council on March 15, 1988, which stated as <br />Condition #1: <br />MINUTE BOOK NO. 50 <br />Page No. 072 Reg.
