8.3.B. - Page 54 <br /> the content of job classifications; to hire, transfer, promote, suspend, discipline and discharge <br /> employees; to assign work to employees in accordance with the requirements of the City; to <br /> establish and change work schedules and assignments; to lay off employees for lack of work; to <br /> expand or diminish services; to subcontract any work or operations; to determine and change <br /> methods of operations; to determine and change work locations and the processes and materials <br /> to be employed;to take all necessary actions to perform its functions in emergencies. <br /> SECTION 5. ASSOCIATION REPRESENTATIVES <br /> City employees who are official representatives or unit representatives of the Association shall <br /> be given reasonable time off with pay to attend meetings with management representatives, or to <br /> be present at hearings where matters within the scope of representation or grievances are being <br /> considered. The use of official time for this purpose shall be reasonable and shall not interfere <br /> with the performance of City services as determined by the Personnel Officer. Such employee <br /> representatives shall submit a written request for excused absence to the Police Department head <br /> or his or her designated representative with an information copy to the City Manager, at least two <br /> (2) working days prior to the scheduled meeting whenever possible. Except by mutual <br /> agreement,the number of employees excused for such purposes shall not exceed two (2). <br /> No Lieutenant shall represent any Sergeant in any grievance or Internal Affairs investigation <br /> procedure, either official or informal, nor will a Lieutenant take part in any Association <br /> discussions involving personnel-related grievances that involve Sergeants or of which they have <br /> confidential knowledge. <br /> No Lieutenant shall share any information obtained pursuant to his or her management duties <br /> that the Chief or Command Staff has designated as confidential with fellow PSA members for <br /> any purpose. <br /> No PSA member shall ask a Lieutenant to disclose any information obtained pursuant to his or <br /> her management duties that have been deemed confidential by the Chief or Command Staff, nor <br /> take any action to compel them to share such information. <br /> No Lieutenant shall hold the position of PSA President or Vice President. Sergeants who are <br /> assigned as Acting Lieutenants for longer than 30 days and hold the office of PSA President or <br /> Vice President will temporarily resign from such office for the duration of the Acting Lieutenant <br /> assignment. <br /> SECTION 6, NO STRIKE <br /> The Association, its members and representatives, agree that they will not engage in, authorize, <br /> sanction, or support any strike, slowdown, stoppage of work, curtailment of production, <br /> concerted refusal of overtime work, refusal to operate designated equipment (provided such <br /> equipment is safe and sound) or to perform customary duties; and neither the Association nor any <br /> representatives thereof shall engage in job action for the purpose of effecting changes in the <br /> directives or decisions of management of the City, not to effect a change of personnel or <br /> operations of management or of employees not covered by this MOU. <br /> 8 <br />
