8.3.B. - Page 64 <br /> • Employees with an annual accrual rate of 120 hours may elect to cash-out up <br /> to 40 hours of accrued and unused vacation. <br /> • Employees with an annual accrual rate of 160 hours may elect to cash-out up <br /> to 80 hours of accrued and unused vacation. <br /> • Employees with an annual accrual rate of 180 hours may elect to cash-out up <br /> to 100 hours of accrued and unused vacation. <br /> • Employees with an annual accrual rate of 200 hours may elect to cash-out up <br /> 120 hours of accrued and unused vacation. <br /> In addition,the following restrictions shall apply: <br /> • Employee must have a minimum of 80 hours of accrued vacation at the time <br /> of election in order to be eligible. <br /> • Employee must utilize a minimum of 80 hours of vacation during the <br /> calendar year in which leave is accrued. <br /> • Employee must have at least 80 hours of vacation leave remaining after the <br /> cash-out is completed. In the event that the amount of vacation to be <br /> cashed out would leave less than 80 hours in the employee's remaining <br /> accrued leave bank, the cash-out amount will be reduced by the amount <br /> necessary in order to retain the minimum 80 hour bank. <br /> The City will endeavor to make payment on the non-payroll Friday immediately <br /> following the first payroll Friday in January following the year in which leave is <br /> accrued; however, the payment will be made no later than the first pay period in <br /> February and shall be paid using the salary in effect December 31 of the year in <br /> which leave is accrued. <br /> Upon payment, accumulated vacation leave credits shall be reduced by the <br /> value of the vacation leave used and compensated as provided in the above <br /> paragraph. <br /> 7.13.6 Excess Vacation Leave Mandatory Cash-Out for 2016 <br /> Any employee who exceeds the maximum vacation accrual (as described in <br /> Article 17.14.3) as of the end of pay period that includes December 31, 2016, <br /> will have his or her balance in excess of the accrual limit cashed out. The City <br /> will endeavor to make payment on the non-payroll Friday immediately <br /> following the first payroll Friday in January 2017; however, the payment will <br /> be made no later than the first pay period in February and shall be paid using <br /> the salary in effect on December 31,2016. <br /> 7.154 Illness During Vacation <br /> 7.1541 An employee who commences a scheduled vacation period and subsequently <br /> becomes ill before his or her vacation period has been completed shall be placed <br /> on sick leave under the following conditions: <br /> 7154.1.1 The employee otherwise qualified for sick leave as provided by this <br /> MOU; and <br /> 18 <br />
