8.3.B. - Page 79 <br /> elects to be reassigned can only displace an employee with less department <br /> seniority than the Police Sergeant exercising reassignment rights. <br /> A sworn Police Lieutenant, who has received a notice of layoff, may elect, in <br /> lieu of layoff, to be reassigned to the rank of Police Sergeant, provided that the <br /> Lieutenant was promoted from the rank of Police Sergeant. The Police <br /> Lieutenant who elects to be reassigned can only displace an employee with less <br /> seniority within the RCPSA unit than the Police Lieutenant exercising his or her <br /> rights. <br /> 13.1.2 An employee requesting to exercise the right to be reassigned into a previously <br /> held, lower-rank position, must make such a request to the Personnel Officer in <br /> writing within seven (7) calendar days of the receipt of the written notice of <br /> layoff. Failure to comply with the deadline provided herein shall be deemed a <br /> waiver of the reassignment rights provided in RCPSA MOU Section 13. <br /> 13.1.3 When an employee chooses to be reassigned to a lower rank position, the <br /> employee will maintain his/her seniority within the department, The employee <br /> must also accept the salary, hour and working conditions of the lower rank <br /> position. If the salary of the employee is within the salary range of the lower <br /> rank classification, the employee will be placed at the step of the lower rank <br /> classification range that is closest to, but no less than, the salary received in the <br /> position held at the time of the layoff notification. If the employee's salary prior <br /> to the reassignment is above the top of the range of the lower rank position,the <br /> employee's salary will be placed at the top of the salary range for the lower rank <br /> classification effective the first date of the reassignment. <br /> 13.1.4 An employee who elects to be reassigned to a lower rank position will not serve <br /> a probationary period in the lower rank position upon reassignment and will <br /> retain regular employment status with the City of Redwood City. <br /> 13.2 Order of Reassignment to the Classification of Sergeant <br /> An employee who is reassigned to a lower rank position due to a reduction in force shall <br /> be placed, for a period of three (3) years from the date of the employee's reduction in <br /> rank, on a promotion list for the position previously held. In promoting for a vacant <br /> position, such a promotion list shall take precedence over all other employment lists and <br /> the last employee reduced in rank shall be the first employee promoted until the list is <br /> exhausted, This applies only to Police Sergeants who were promoted to the rank of <br /> Police Sergeant directly from the Redwood City POA, and Police Lieutenants promoted <br /> to the rank of Police Lieutenant directly from the rank of Police Sergeant with the City of <br /> Redwood City. <br /> 13.3 Break in Service <br /> Service with the City shall be terminated by discharge, resignation, refusal by an <br /> employee to accept a reassignment to a related classification as stated in RCPSA MOU <br /> Section 13.1, six (6) consecutive months of unemployment with the City of Redwood <br /> 33 <br />
