REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />November 7, 2016 <br /> <br />SUBJECT <br />General Vacation of Public Rights-of-way being a portion of Hancock Street, Spruce <br />Street, and Buckeye Street <br /> <br />RECOMMENDATION <br />1. Adopt a Resolution of Intent to vacate right-of-way, dedicated to the City for <br />Public Use; <br />2. Set a Public hearing on the matter for December 12, 2016 at 7:00 p.m. in the City <br />Council Chambers; <br />3. Direct the City Clerk to publish and post notice of said hearing in accordance with <br />state law <br /> <br />BACKGROUND <br />On August 16, 2016 the Planning Commission approved the vesting tentative map to <br />merge multiple parcels into a single developable lot, and construct a four story, 37,207 <br />square foot mixed used building at 1629 Main St. Due to the complicated nature of the <br />underlying fee ownership for the parcels, the City is required to follow the Streets and <br />Highways Code and the general vacation procedure. There are City owned utilities <br />located within the easement area, and so several easement reservations are required <br />as part of the project. No franchise utility companies have requested easement <br />reservations when contacted about the vacation. <br /> <br />ANALYSIS <br />The rights-of-way were dedicated to the City as part of the “The Eastern Addition of <br />Redwood City” subdivision dated October 1861. At the time CA Highway 84 (Woodside <br />Road) did not exist, and sometime later the State of California acquired the adjacent <br />lands and a portion of the rights-of-way through the process of eminent domain. <br />Through this process they also acquired a portion of the underlying fee ownership for <br />the parcel beneath Hancock Street, and in order for the developer to obtain the <br />underlying fee ownership the State of California has required that the rights-of-way be <br />vacated. Given that there are City owned utilities, this dictates that the general vacation <br />procedure be followed. <br /> <br />The Streets and Highway Code Section 8300 authorizes the vacation of public rights-of- <br />way by an order of City Council. The general vacation, once complete, will relinquish the <br />City’s interest in the right-of-way, and the right-of-way will revert to the fee owners, who <br />6.3.C. - Page 1
