the appellant's property incurred as a result of the construction work.

The removal of the applicant's existing fence during construction should not
present a safety hazard. The building code requires temporary fencing be
installed during construction for the safety and welfare of the public in
general. Once construction is completed, the fence will be replaced by the
new wall, creating a more permanent barrier between the two properties.

Since the applicant has indicated that he intends to comply with all safety
regulations, construction standards, and code requirements, it is not expected
that the construction of the proposed addition will pose a safety hazard to
the appellant's family, only a temporary inconvenience. As stated by the
applicant, any property damage resulting from the construction work will be
repaired and restored to its original conditions.

4.

Conclusion

For all of the foregoing reasons, the appeal is denied, and the decision
of the Zoning Administrator is affirmed.

Carried by the following roll call vote:
AYES: Council Members Buchan, Greenalch, Murray, Stangel and
Mayor La Berge
NOES: None
ABSTENTIONS: Councilman Claire

MINUTE ORDER NO. 9t:QfQ

City Attorney Schricker, for the record, advised that the proximity of Council
Member Murray's house to the house of the applicant at 377 Quay Lane does not
prejudice his ability in any manner, and Council Member Murray is entitled to
vote on the question of the appeal as his property is NOT affected by any
decision made in this matter.

----------------------------------------------------------------------------------

MEMO 2/12/91

6.
