IREPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> May 6, 2002 <br /> <br />Subject <br />Options for 2233 Middlefield Road (Opfer Property) <br /> <br />Recommendation <br />That the City Council approves the Development Agreement (DA) as attached. <br /> <br />Background <br />Council heard this issue on February 25, 2002. The staff report for that meeting is <br />attached for your reference. At the February 25, 2002 meeting the Council opened and <br />closed the public hearing on the issue. Since the public headng was held and closed there <br />is no further public notice required for this action. The Opfer family has, of course, been <br />informed of the meeting. <br /> <br />The motion that was approved by Council was: <br /> <br />M/S Jordan/Howard to continue the item to a future date; extend the Architectural Permit, <br />preserving the pipeline status; staff to return with alternatives and ramifications on policies <br />and provide construction cost analysis with consideration of practical alternatives to <br />improving the entire street. Staff to include additional information on other pipeline projects <br />in order to analyze this proposal in that context. To be included is consideration of <br />language allowing the owner to terminate the agreement at any time prior to <br />commencement of construction of the foundation of the building. This motion passed by <br />unanimous voice vote. <br /> <br /> MINUTE ORDER 02-57 <br /> <br />The City Manager further clarified that Council was not asking for re-negotiation of items <br />with the owner but that staff would simply present options to the Council. <br /> <br />The points in the motion will be discussed following: <br /> <br />Architectural Permit <br />This was extended for six months from February 25, 2002, or to the date of final action on <br />the DA, whichever should occur first. The Opfer project's status with regard to the pipeline <br />is thus preserved. <br /> <br />If the Council decides not to approve any DA for this project, then the Architectural Permit <br />for the proposed 7,500 square foot building would expire.
