Existing Section Modification <br />New Section 40.5 (Architectural Advisory Committee Duties) refers to duties <br />specified in the resolution. Referenced as a Brown Act Committee <br />that participates in development review. <br />New Section 40.6 (Historic Resources Advisory Commission) refers to the <br />duties and powers specified in the Municipal Code. <br /> <br />New Section 40.7 (Subdivision Committee) refers to the duties and powers <br />specified in the Municipal Code. <br />Article 41 – COMMON PROCEDURES <br />Existing Section Modification <br />41.1 through 41.6 Moved to 49 (Amendments) <br />New Section 41.1 (Purpose) that describes the purpose of the article to identify <br />processes that are common to the processing of all permits. <br />New Section 41.2 (Application Filing and Fees) simplified versions of 42.2, 43.2, <br />44.2, 46.4, 52.8, 56.4 in what application materials and fees are <br />required. Leaves Director with discretion on required materials. <br />New Section 41.3 (Review of Application) Completely new section that describes <br />determination of completeness, expiration of pending incomplete <br />application, time to decision, and extensions to review timelines. <br />Consistent with Permit Streamlining Act and CEQA. Replaces 52.8 (PC <br />Permits, Application). <br />New Section New Section 41.4 (Review Authorities for All Permits). Review <br />authorities for permits are provided for in individual permit articles, <br />but particular circumstances require specific reviews. This section <br />describes review of multiple applications, environmental documents, <br />and construction exceeding 35 ft., referrals and call-ups. <br />New Section 41.5 (Public Notice) This section has been moved from Article 49 and <br />simplified to refers to state law and the Downtown Precise Plan. The <br />actual public notice process will be in a separate policy document. <br />New Section 41.6 (Decisions and Permit Effectiveness) consolidated version of <br />42.3A, 43.4, 43.5, 43.6, 45.6B and C, 46.5, 46.6, 52.10C, 52.12 in <br />describing what actions the review authority may take, when the <br />decision becomes effective and clarifying the date of action. <br />New Section 41.7 (Appeals) reworded form of Article 48 (Appeals). <br />· Time to hearing for appeals to PC has been extended from 60- <br />90 days, to be consistent with all other time periods. <br />· Requirements are rephrased in everyday language. <br />New Section 41.8 (Call Ups) is a reworded portion of Article 48. <br />· Council call-ups are separated from the appeal process. <br />· Council can call up to both PC and CC. <br />· Requirements are rephrased in everyday language. <br />New Section 41.9 (Permit Expiration and Extension) is a consolidated version of <br />43.6, 46.11, 52.13 describes the length of permit effectiveness and <br />cessation of use. Clarifies that extension would be granted “for good <br />cause.” <br />New Section 41.10 (Modification of Approved Plans and Permits) describes <br />7.C. - Page 42
