Existing Section Modification <br />process for review of minor and major modifications. Inconsistently <br />stated throughout the current ordinance. <br />New Section 41.11 (Permit Continuity) describes what happens to permits when <br />the zoning district changes on the land with a current permit. Only <br />described in 42.8 Use Permits, 43.9 Variances but useful for all <br />permits. <br />New Section 41.12 (Reapplication) prohibits reapplying for a substantially similar <br />application within one year of a decision. 43.8 Variances and 42.7 Use <br />Permits, but useful for all types of permits]. <br />New Section 41.13 (Interpretations) allows for Director interpretations with <br />broader language, but similar to 51.1B. <br /> <br />Article 42 – USE PERMITS <br />Existing Section Modification <br />42.1 - Procedure. This section is <br />replaced with a purpose statement for what a Use Permit process <br />would achieve and why it would be required. <br />42.2 – Application Moved to 41.2 (Application Filing and Fees). Replaced with an <br />applicability section that describes when Use Permits are generally <br />required. <br />42.3 – Zoning <br />Administrator Action. <br />This section was split. Decisions were moved to 41.6 (Decisions and <br />Permit Effectiveness). The statement of review authority remains, <br />and section title is renamed to “Review Authority.” The findings were <br />moved to 42.4 (Findings). <br />42.4 – Conditions Moved to 41.6 (Decisions and Permit Effectiveness). Renamed <br />“Findings” with relocated findings from original section 41.3. <br />42.5 – Modifications and <br />Revocations of Use <br />Permit <br />Moved to 42.6 (Use Permit Modification or Revocation). Cross <br />reference to common procedures inserted and section renamed. <br />42.6 – Abandonment of <br />Use <br />Moved to 41.9 (Permit Expiration and Extension). Section deleted. <br />42.7 – Reapplication Moved to 41.12 (Reapplication).
