<br />Clarence Cravalho, 1265 Vancouver Street, Burlingame, reiterated position <br />that Taco Bell promised not to pursue a drive through component at <br />this site. <br /> <br />In response to Council questions, Senior Planner Passanisi advised that in <br />that area restaurants do require Conditional Use Permits, which involve a <br />Public Hearing and possibility of conditions. <br /> <br />Council discussed the possibility of not requiring an EIR at this point in <br />the process, and sometime in the future having to consider an application <br />for a drive through component based on undue financial hardship and <br />precedent; discussed the purpose of an EIR which is to provide information <br />regarding traffic, noise, litter, etc.; and reiterated the question before <br />them was the decision to require an EIR and not the application by Taco Bell <br />for a fast food restaurant. <br /> <br />Mayor La Berge asked if anyone else wished to speak. <br />speak. <br /> <br />MIS: MurraYIStangel to close the Public Hearing. <br />Carried by unanimous voice vote and Hearing closed at 9:24 p.m. <br /> <br />No one wished to <br /> <br />M/S: Murray/Bury to reject appeal of Planning Commission decision to <br />require an EIR for the proposed fast food restaurant at 120 El Camino Real <br />with the following Findings: <br /> <br />FINDINGS: <br /> <br />1. An EIR is justified under the California Environmental Quality Act, <br />state guidelines and local guidelines implementive of that Act, with respect <br />to the necessity for Environmental Impact Reports for projects having the <br />potential to be controversial. <br /> <br />2.
