acceptable to City. Ownership of these facilities will transfer to City upon its <br /> acceptance. <br /> 5.8 Warranty Enforcement <br /> SBSA will take all appropriate actions to enforce rights under the Construction <br /> Contract Documents, including warranties as to the work. With respect to <br /> facilities located on SBSA's property but owned by City, SBSA will, upon <br /> request, assign its warranty rights to City and will provide full support and <br /> assistance to City if City elects to seek warranty performance against the <br /> Construction Contractor and/or its surety. <br /> 6.0 OPERATION <br /> 6.1 SBSA Authority/Responsibility for Operation <br /> SBSA will have the sole authority to operate the Treatment Facilities upstream of <br /> the Point of Delivery(i.e., Facilities 1, 2, 3 and 10 on Attachment One) and will <br /> be solely responsible for delivering Recycled Water to the Point of Delivery in the <br /> quantities, of the quality, and at the times required by this Agreement. <br /> 6.2 Delivery of Recycled Water to City—Production Rate <br /> SBSA will deliver Recycled Water to the Point of Delivery in the quantity <br /> requested by City up to 9,000 GPM, subject to the availability of Net Influent, <br /> which is defined in Attachment Ten and illustrated in Attachment Eight. <br /> 6.3 Delivery of Recycled Water to City—Quality <br /> SBSA will deliver Recycled Water to the Point of Delivery that continuously <br /> meets (a)the criteria for Disinfected Tertiary Recycled Water as set forth in Title <br /> 22 California Code of Regulations Section 60301.230; (b)the requirements of San <br /> Francisco Regional Water Quality Control Board Order No. 96-011; and(c) any <br /> -11- 1091374.7 <br />
