6.4 Timing of Deliveries of Recycled Water
The parties recognize that customer demand for Recycled Water will be variable.
Each January City will provide SBSA with an estimate of monthly demand for the
upcoming calendar year. During the year, if City becomes aware of any
developments that may change its demand projection, such as a major new
customer, it will give SBSA prompt notice of the change. So long as City is
supplying water only to irrigation customers, and therefore requires Recycled
Water only seasonally, it will give SBSA two (2) weeks' notice of when City will
need Recycled Water deliveries to commence.
6.5 Operating Procedures
SBSA will operate the Treatment Plant, including the Recycled Water Facilities 1,
2, 3 and 10 on Attachment One, in accordance with applicable permits and with
the "Operational Plan-Recycled Water"to be described in the Engineering
Report.
6.6 Maintenance and Repair
SBSA will maintain the Treatment Plant, including the Recycled Water Facilities
which it owns (Facilities 1, 2 and 10 on Attachment One), or which it is obligated -
to maintain under this Agreement (Facility 3), in good operating condition and
repair. City will maintain the other Recycled Water Facilities in good operating
condition and repair. City may inspect the Treatment Plant, including but not
limited to Facilities 1, 2 and 10, at all reasonable times on 24 hours' prior notice
to SBSA,with respect to the production of Recycled Water.
-13- 1091374.7
T... i .
