6.9 Recordkeeping and Reports <br /> SBSA will keep complete and accurate records as required by law, by applicable <br /> regulations, as described in the Engineering Report and as necessary to carry out <br /> this Agreement, including financial records required to implement Article 7.0. <br /> SBSA will provide City access to all of its records related to this Agreement <br /> during normal business hours. City may, at its expense, make copies of such <br /> records. <br /> SBSA and City will submit joint reports to the RWQCB, the DOHS, or to any <br /> other regulatory agency that has issued a joint permit or entitlement to the parties. <br /> The parties shall each prepare that portion of such report that pertains to their <br /> respective facilities or responsibilities. They shall coordinate their efforts in that <br /> regard in order to facilitate preparation and timely submittal of such reports. To <br /> the maximum extent feasible, such records and reports will be provided in <br /> electronic format. <br /> If City or SBSA are required to file separate reports on the Project by any <br /> regulatory agency, each will promptly provide the other with a copy of that report. <br /> 6.10 Compliance with Permits <br /> SBSA will operate the Treatment Plant and Project Facilities within its control <br /> (Facilities 1, 2, 3 and 10) in full compliance with all applicable laws and <br /> regulations, including those of the State Water Resources Control Board codified <br /> at 23 CCR Section 3670 et seq., and with all permits. <br /> -16- 1091374.7 <br />
