As of the Effective Date hereof, SBSA has contracts in place with certain <br /> engineering and consulting firms which are currently performing work on Project <br /> facilities to be located on SBSA's property. These contracts,the scopes of work <br /> and budget authorizations now in force are listed on Attachment Three. From and <br /> after the Effective Date, SBSA will not enter into any additional professional <br /> services contracts related to the design of, or preparation of Construction Contract <br /> Documents for, Project facilities to be located on SBSA's property, nor issue any <br /> additional or supplementary task orders under the contracts listed on Attachment <br /> Three, without prior written approval of City. SBSA will furnish City a draft of <br /> any task order it believes necessary to issue at least five (5) days in advance of the <br /> date by which SBSA believes it necessary to be issued, in order to allow sufficient <br /> time for City's review. <br /> If City requests,the existing contracts listed on Attachment Three will be <br /> amended to address issues of particular concern to City, such as its status as a <br /> third party beneficiary, being named as an additional insured on the contractors' <br /> liability insurance policies, etc. <br /> For Project facilities to be located on SBSA's property and owned by City, <br /> described as items 3 through 9 and 11 in Attachment One, submissions of design <br /> work and Construction Contract Documents by the engineering firm(s) at the 10 <br /> percent, 60 percent, 90 percent and 100 percent final stages of completion shall be <br /> reviewed by, and shall be subject to approval of,both SBSA and City. Estimates <br /> of Probable Construction Cost will be provided with each submittal, along with a <br /> description of major design decisions that impact capital costs. <br /> -4- 1091374.7 <br />
