3.2 Permits for Construction of All Other Facilities
City will be responsible for securing all permits and other governmental approvals
for all Project facilities not located on SBSA's property.
3.3 Permits for Operation of Project
SBSA and City shall jointly apply for approvals from the California Department
of Health Services (DOHS) and the San Francisco Bay Regional Water Quality
Control Board (RWQCB). The Parties anticipate that this will be accomplished
by filing a Notice of Intent with DOHS and/or RWQCB, as appropriate,
accompanied by:
• an Engineering Report meeting the requirements of 22 CCR§60323 and the
DOHS "Guidelines for Preparation of Engineering Reports for the Production,
Distribution and Use of Recycled Water" as of the Effective Date of this
Agreement; and
• a Water Reuse Program Technical Report meeting the requirements of
RWQCB General Order 96-011,Attachment B.
Advertisement for bids for construction of the Project facilities on SBSA's
property, or the first component thereof, shall not be published until the above-
mentioned Engineering Report has been approved by DOHS and all other
entitlements for construction have been approved or issued.
RWQCB General Order 96-011, Section C allows certain responsibilities imposed
by that section upon the "producer" of Recycled Water to be undertaken instead
by the "distributor,"in which case the producer and distributor must provide the
RWQCB an agreement allocating their respective responsibilities.
-6- 1091374.7
