Code § 27383. <br /> AMENDED AND RESTATED STORMWATER <br /> TREATMENT MEASURES MAINTENANCE <br /> AGREEMENT <br /> Stanford Hospital Clinics <br /> 420450 Broadway <br /> THIS STORMWATER TREATMENT EASU}3ES MP1IRTENANCE AGREEMENT <br /> ("Agreement") is made and entered into ) , 20_ 'Effective Date") , by and <br /> between the City of Redwood City ("Ci and Stanford Health Care, a California <br /> nonprofit public benefit corporation ("Property Owner") . <br /> RECITALS <br /> A. On November 19, 2015, the Regional Water Quality Control Board , San <br /> Francisco Bay Region , adopted Order R2-2015-0049, amending the San Mateo <br /> Countywide NPDES Municipal Stormwater Permit (Order 99-059, CAS0029921 ) (the <br /> "NPDES Permit"); and <br /> B. Provision C.3. of the NPDES Permit, as it may be amended or reissued from <br /> time to time, requires the permittee public agencies to provide minimum verification and <br /> access assurances that all treatment measures shall be adequately operated and <br /> maintained by entities responsible for the stormwater treatment measures; and <br /> C. The Property Owner is the owner of real property commonly known as 420- <br /> 450 Broadway, Redwood City, CA 94063 (the "Property") , as more particularly described <br /> in Exhibit "A", attached hereto and incorporated herein by this reference; and <br /> D. On August 28, 2007, the Parties executed a Stormwater Treatment <br /> Measures Maintenance Agreement (the "Former Agreement") for the maintenance of the <br /> installed treatment devices for the Property, which was recorded against the Property on <br /> August 30, 2007. Dex- melt # 0200'r - 13t-7 't7 <br /> E. The Parties desire to amend and restate the Former Agreement in its entirety in <br /> order to comply with the current NPDES Permit Order. <br /> F.
