hereby established, and shall become effective upon the effective <br /> date of Ordinance NoJ 73 () entitled "Ordinance Transferring and <br /> Conferring Control and Jurisdiction Over a Portion of Lands Within <br /> Port Area of the City of Redwood City (Municipal Marina) ," <br /> introduced on November 21, 1977, by the Council of the City of <br /> Redwood City: <br /> (a) The lands described in said ordinance shall continue to <br /> be used as a small craft harbor facility for recreational <br /> and related commercial purposes; provided, that nothing <br /> herein contained shall preclude the further improvement <br /> and development of said lands for such purposes. <br /> (b) The control and jurisdiction conferred upon the Board of <br /> Port Commissioners pursuant to the aforementioned ordinance <br /> shall be exclusive in accordance with the Charter of the <br /> City of Redwood City, and shall include, but shall not <br /> necessarily be limited to: <br /> (i) All administrative responsibilities, including <br /> provision for the security and patrol of said <br /> lands and waterways; <br /> (ii) The establishment of policies, consistent with <br /> paragraph 1(a) , above, for the use of all lands <br /> within said area, and the administration of all <br /> leases, permits, and/or other agreements imple- <br /> mentive of such policies; and <br /> (iii) Operation, maintenance, repair, construction, <br /> and provision for all facilities and improvements <br /> within said lands. <br /> (c) In the event that any services, supplies, or improvements <br /> are furnished or provided by the City of Redwood City, <br /> under the jurisdiction of the Council of Redwood City, <br /> to or for the benefit of said lands, provision shall be <br /> made, except as may otherwise be provided, for the <br /> payment thereof by the Port of Redwood City at the <br /> fair value thereof. <br /> (d) The City of Redwood City, under the jurisdiction of the <br /> Council of Redwood City, shall, as soon as practicable, <br /> pay and completely discharge the remaining loan balance, <br /> together with interest, penalties, and/or fees, if any, <br /> payable to the State of California under that certain <br /> agreement dated January 22, 1960, and those certain <br /> amendments to said agreement dated May 23, 1966, and <br /> November 27, 1967, with the State of California <br /> (acting by and through the Division of Small Craft <br /> Harbors, Department of Natural Resources; Division of <br /> Small Craft Harbors, Department of Parks and Recreation; <br /> and Department of Harbors and Water Craft, respectively) . <br /> -2- <br />
