Councilman Granger offered substitute motion to take no action at this time and <br />continue this matter for a week to see if any corrective action taken. No <br />second to motion. <br />Councilman Henderson offered substitute motion that use permit not be revoked <br />provided Mr. Woods meets all five conditions within 90 days and if not met, use <br />permit be automatically revoked. <br />City Attorney clarified actions possible and implication, if no action taken. <br />Councilman Granger moved to close the public hearing, seconded by Councilman Bury <br />and carried. <br />Councilman Henderson moved to adopt RESOLUTION NO. 5091 APPROVING RECOMMENDATION <br />OF THE PLANNING COMMISSION OF THE CITY OF REDWOOD CITY THAT IN LIEU OF REVOCATION <br />OF THE USE PERMIT OF CHARLES W. WOODS (U63-72) NEW CONDITIONS SHALL BE ATTACHED <br />THERETO, seconded by Councilman Bury and carried on roll call vote, Councilman <br />Keekley voting no. <br />Mayor Herkner asked that a copy of Fire Marshal's letter be sent to Mr. Woods. <br />Councilman Granger moved that a further report be made to Council at meeting <br />of August 1st on this matter, seconded by Councilman Rosselli and carried. <br />(Memo 7/19/66) <br />PUBLIC HEARING, Appeal of C. W. Lebsack on behalf of Mildred Drivon from denial by <br />the Planning Commission of her application for a variance to Sections of Ordinance <br />1130, to permit the construction of a single-family dwelling, in an R-1 District <br />at 303 King Street, (a) a lot area of 3250 sq. ft, instead of 6,000 sq. ft., as <br />required by Section 5.6; (b) an average lot width of 25' instead of an average <br />width of 50', as required by Section 5.7; (c) a street frontage of 25' instead of <br />351, as required by Section 5.7, declared open and affidavits of publication and <br />mailing ordered filed. Report of the Planning Commission read in which it was <br />recommended that this variance be denied. Staff report stated applicant owns <br />_ two lots of the original subdivision known as Central Park, corner lot being 50' <br />x 130' with a single-family dwelling and detached garage, vacant adjacent lot <br />being 25' x 130' on which applicant wishes to construct a small single family <br />house. Council was advised of a petition being received by City Clerk's office <br />protesting granting of this variance bearing 19 signatures. <br />C. W. Lebsack, attorney for appellant, presented a <br />petition bearing 32 signatures of residents in the <br />area favoring granting of this variance, together <br />with photographs of houses in the area similar to <br />that proposed, and a proposed plan of the single- <br />family dwelling proposed for this site. Mr. Lebsack <br />reviewed the history of 25' lots in this area, the <br />length of time this parcel had been under the ownership <br />of the appellant and her desire to build on this lot <br />for her own use because of family needs of present <br />home. He also outlined fact present home could have a <br />garage attached to permit a redivision of the lot but <br />felt this would not be as aesthetically acceptable to <br />neighborhood as plan proposed. <br />Jim Rice, 334 King Street, stated petition protesting <br />granting of this variance had been signed by owners of <br />property in immediate vicinity. He felt lot should <br />be division in another manner. <br />Slide shown of the proposed plan and explained by Staff. Councilman Granger ques- <br />tioned whether Planning Commission had suggested substitute plan for division and <br />use of this parcel. <br />Mr. Shattuck, owner of property directly across the <br />street from this site, 308 King St., favored granting <br />of the variance as he felt proposed building plan would <br />be improvement over a vacant lot. <br />Councilman Rosselli questioned whether compromise would be acceptable to those <br />present for a different division of the lot. After further discussion and ques- <br />tioning by Counci;, Councilman Petersen moved to close the public hearing, seconded <br />by Councilman Henderson and carried. <br />
