326 <br />City Attorney outlined ordinance concerning closing out sales as not containing <br />provision restricting sales during December but permitting an investigation period <br />of 60 days, which in effect allowed Council a holding period. <br />Walter Hilton, representing his father as owner of Hilton <br />Jewelers, protested closing out sale during month of <br />December, stating permit should be allowed to December lst <br />only. <br />Everett Swank, of Kessington Jewelers, advised sale of this <br />kind in December would be detrimental to other jewelers, as <br />large inventories now on order anticipating Christmas sale <br />period. <br />Councilman Rosselli made substitute motion to permit closing out sale Permit to <br />Mr. Rudick for period of thirty days, terminating December lst, seconded by Coun- <br />cilman Keckley. On question, Councilman Bury asked if the restrictions on closing <br />out sales pertained to the advertising only, and that this business need not close <br />after termination of the sale period. City Attorney stated the restriction related <br />only to advertising as sale could continue without being advertised as a closing <br />out sale. <br />Councilman Granger asked City Attorney's statement be included in the record that <br />a sale could continue after closing out sale permit expired, provided it is not <br />advertised as "Closing Out Sale". Motion carried on roll call vote, Councilmen <br />Bury, Granger, Keckley, Rosselli and Mayor Herkner votingyes, Councilmen Hender- <br />son and Petersen voting no. W-2; <br />ALL OTHER BIDS RECEIVED; AUTHORIZING EXECUTION OF CONTRACT FOR SAID <br />WORK; AND DIRECTING RETURN OF SECURITY DEPOSIT, seconded by Councilman Granger and <br />carried on roll call vote. <br />Councilman Granger moved to adopt RESOLUTION NO. 5174 APPROVING PLANS AND SPECIFICA- <br />TIONS FOR THE CONSTRUCTION OF REDWOOD AVENUE AREA WATER SYSTEM IMPROVEMENTS, PRO- <br />JECT W-1; AND AUTHORIZING CITY CLERK TO CALL FOR BIDS THEREFOR. City Manager <br />pointed out work to be performed does not entirely conform in total with the original <br />report by Adamson but believed to be best engineering practice to combine into one <br />job which is still within GID 2-65 construction funds. Motion seconded by Council- <br />man Bury and carried on roll call vote. <br />Councilman Keckley moved to adopt RESOLUTION NO. 5175 AUTHORIZING CITY CLERK TO CALL <br />FOR BIDS FOR OPERATION AND MAINTENANCE OF DEWATERING PUMPS FOR GENERAL <br />
