City Attorney <br />detailed portion of roadway on the area, the procedures and the need for this <br />agreement and recommended Council proceed. <br />Motion carried on roll call vote,_ Councilman Henderson voting no, Councilman Bury <br />being noted absent. <br />REPORT OF BID OPENING, Dredge Exterior Waterways -1 (Belmont Slough). <br />The following bids were received: <br />Bragato Paving Company $496,309.00 <br />Piombo Corp. 533,350.00 <br />Oscar C. Holmes 737,115.00 <br />Engineer's Estimate $552,100 <br />DMJM and Staff recommend award be made to low bidder, Bragato Paving Company, <br />subject to receipt of all permits and documents. City Manager reported City now <br />has all three permits required for dredging and in addition he had been advised by <br />Wells Fargo Bank, that ABC had deposited $200,000 in escrow as part of terms of <br />agreement and escrow instructions had been signed by all parties concerned. <br />Councilman Henderson questioned whether bid award should be made until agreement <br />signed on roadway relocation. City Attorney advised we have already taken pos- <br />session of the necessary property including the roadway strip, that this agree- <br />ment will eliminate some action from the condemnation. Councilman Henderson asked <br />for information regarding permits, and was advised by City Manager that only the <br />deed from Leslie was still to be signed, and by City Attorney it was possible <br />to award without documents in hand. <br />Motion carried on roll call vote, Councilman Bury being noted absent. <br />Mayor Herkner felt City Manager and City Attorney should be congratulated on nego- <br />tiations which had been successfully concluded in this matter. <br />Request of Bay Area Grocer's Association for reconsideration of effective date of the <br />Cigarette Tax. <br />Mr. Stanley F. Johnson, Executive Director of Bay Area <br />Grocers Association, Inc. presented petition purportedly <br />signed by 3,800 customers of retail grocers in City, to- <br />gether with petition signed by retail merchants, asking <br />that Council rescind its recent action in imposing a <br />municipal cigarette tax until such a tax is established by <br />State Law on a uniform basis. <br />
