He stated petitions do not state opposition to tax <br />merely stating preference that they not be put in an <br />unfair competitive position until anticipated State <br />legislation is again acted on. He further recited <br />percentages of loss of business in other areas which <br />had been made from a survey where adjacent communities <br />did not have this same tax. <br />Councilman Rosselli stated City's desire to maintain home rule in this instance <br />and not wanting State to preempt field. He also recited need which had compelled <br />Council to enact this proposed tax. <br />John Kelly, of California Association of Tobacco Dis- <br />tributors, stated their research indicated State without <br />power to preempt chartered cities from this tax, but <br />agreed to competitive difficulties to merchants if tax not <br />uniformly imposed. <br />After further comment by Council members as to need for gaining more revenue for <br />City and thorough study before this ordinance enacted, Council indicated no desire <br />to take further action. <br />Councilman Petersen moved to adopt RESOLUTION NO. 5216 REQUESTING REMOVAL OF REAL <br />PROPERTY ACQUIRED BY THE CITY OF REDWOOD CITY FROM COUNTY ASSESSMENT ROLLS AND <br />CANCELLATION OF OUTSTANDING TAXES THEREON, seconded by Councilman Henderson. <br />Staff report stated this property had been acquired by the City for fire sta- <br />tion site. Motion carried on roll call vote, Councilman Bury being noted absent. <br />Councilman Rosselli moved to accept Jefferson Branch Channel Improvements, Project <br />SD -3, subject to the usual guarantees of material and workmanship, as recommended <br />by Staff, seconded by Councilman Henderson and carried. (MINUTE ORDER #66-252) <br />Councilman Rosselli moved to adopt RESOLUTION NO. 5217 WITHDRAWING ANNEXED TERRITORY <br />BEING A PART OF THAT ANNEXATION KNOWN AS "EDGEWOOD HILLS ANNEXATION" FROM WOOD - <br />SIDE FIRE PROTECTION DISTRICT, seconded by Councilman Henderson and carried on <br />roll call vote, Councilman Bury being noted absent. <br />Proposed amendments to ABAG Goals Committee recommendations. <br />Mayor Herkner reported his analysis and recommendation had been submitted to <br />Council, after consultation with alternate representative and asked that authority <br />be given him to vote on amendments as had been recommended. (For full text SEE <br />City Clerk's File - ABAG - Legislative Committee) Councilman Rosselli read <br />article from Division of Home Rule Committee, of League of California Cities, and <br />which had been discussed at their recent meeting attended by him, which did not <br />agree with approval of ABAG Goal Committee recommendations. He advised Home <br />Rule Committee had recommended at least four more meetings to discuss this subject <br />matter as it was most complex and most of cities had indicated their desire to <br />maintain "home rule". He also reported having received several telephone calls <br />from citizens which made it apparent there had not been enough publicity given to <br />this matter.
