390 <br />ON ROLL CALL the following were noted present: Councilman Robert H. Bury, presiding <br />as Vice -Mayor in absence of Mayor Herkner, Floyd D. Granger, Mary W. Henderson, <br />Paul C. Keckley, John S. Rosselli and City Clerk Helen C. Moore. Councilman Herbert <br />G. Petersen and Mayor Sidney D. Herkner, being noted absent. Vice -Mayor Bury <br />announced Mayor Herkner absent from the City on official business and Councilman <br />Petersen had sent notice that he would be late in arriving. <br />Also noted present were City Manager Howard C. Ullrich, City Attorney Richard E. <br />Gardella, Assistant City Manager Henry V. Burget, Planning Director Ken Schroeter, <br />Director of Public Works, J. Louis Scherer, Auditor -Accountant Jack Ference, <br />Building Inspector S. H. Kreiss and Deputy City Clerk Marian McCrindle. <br />Councilman Keckley moved to approve Minutes of Regular Meeting of December 5, 1966, <br />seconded by Councilman Henderson and carried. <br />Councilman Henderson announced Personnel Committee requested legislative action on <br />Salary Ordinance be continued for one week and that Council meet in Executive <br />Session at 7:00 p.m. December 19th, prior to regular weekly study meeting. Vice - <br />Mayor Bury advised motion would be made for adjournment as requested at close of <br />meeting. <br />Councilman -Granger moved that discussion concerning proposed Grading Ordinance be <br />deleted and continued to a later date. He expressed City's concern over present <br />slide occuring in the hill area, but stated proposed ordinance should be completely <br />separated from this present issue. Vice -Mayor Bury suggested item be continued to <br />meeting of January 9, 1967. Motion seconded by Councilman Rosselli and carried. <br />(MINUTE ORDER #66-254) <br />City Manager asked that item concerning report of bid opening, Weed Eradication, be <br />continued for one week as Staff still checking bids and recommendation not completed <br />Councilman Rosselli moved to continue this item for one week as requested, seconded <br />by Councilman Granger and carried. (MINUTE ORDER #66-255) <br />Report of Planning Commission on referral by Council of appeal of Land Development <br />& Investment Company, land owners, from denial by the Planning Commission of one <br />segment of the original application of the Harker Development Company for amendment <br />to the Zoning Map to rezone three land segments, bounded by Broadway, Woodside <br />Expressway, Bay Road, and the Southern Pacific Railroad spur, being portion from <br />IP to IR -A District. Report of Planning Commission read advising this subject was <br />re -considered at their meeting of December 6, 1966, and had reaffirmed their earlier <br />recommendation to deny the rezoning to IR -A until after the construction of a motel <br />and restaurant was underway. <br />Mr. H. B. Grabau, local representative for applicant, <br />Harker Development Company, requested Council consider a <br />continuance of this matter until January 9, 1967, and <br />include a re -opening of the public hearing. <br />City Attorney advised Council, inasmuch as public hearing on appeal had been closed, <br />but final action on decision had not been taken pending report on referral to the <br />Planning Commission, Council could ether make a decision at this point, postpone <br />making a decision, or reset for public hearing. Councilman Keckley asked reason <br />applicant desired holding up decision of Council. <br />
