4®n <br />Staff recommended award of bid to low bidder, Killroy Pest Control. <br />The following communication presented during Council meeting was read: <br />Nu -Lawn Chemical Company, 447 Maple Way, Redwood City, <br />protesting bid submitted by Killroy Pest Control was <br />not a responsible bid for following reasons: <br />1. The bid was not accompanied by a bidder's bond or certified _ <br />check. <br />2. The signature was not notarized. <br />3. No list of subcontractors was given. <br />4. The bid was not properly marked and sealed. <br />Nu -Lawn Chemical Company alleged their bid, therefore, <br />was the lowest responsible bid. <br />City Manager stated recommendation that bid be awarded to low bidder, Killroy Pest _ <br />Control, was made with facts stated known to the Staff as City Attorney had indi- <br />cated irregularities were waivable. City Attorney advised first two of the alle- <br />gations were known to him and were waivable provisions of the specifications. He <br />further advised lack of subcontractor listing not an irregularity as it implied <br />work was to be done by Company without subcontractors. <br />City Clerk reported excellent bank reference was given Company by bank on which <br />personal check submitted. Councilman Granger expressed opinion that other bidders <br />meeting all requirements of specifications should be given consideration. Coun- <br />cilman Petersen questioned whether Killroy Pest Control understood ramifications <br />of contract completely. Director of Public Works reported on investigation made <br />by Staff to check responsibility of Company and Staff's concurrence with recom- <br />mendation that bid be awarded to Killroy Pest Control. <br />Councilman Rosselli questioned whether any problems would be foreseen; otherwise, <br />if acceptance of bid not advisable, would recommend re -bidding procedure. Council <br />questioned effect on weed eradication should program be delayed by rebidding. <br />City Manager advised specifications called for eradication of weeds before height <br />of 6" and delay would cause problems, because later spraying on hardier weeds <br />less effective. <br />Director of Public Works stated a series of three sprayings were scheduled accord- <br />ing to specifications, beginning when weeds up to 6", and delaying such program <br />might call for disking. Councilman Bury questioned difference between low bid and <br />the other two, and also questioned whether it was felt there might be any misunder- <br />sta nding on this Company's part for obligations to be contracted for in weed <br />eradication program. Councilman Keckley felt low bid should be accepted in view of <br />statements made as to waivable irregularities. <br />Councilman Keckley moved to adopt RESOLUTION NO. 5231 AWARDING CONTRACT IN CONNEC- <br />TION WITH THE WEED ERADICATION PROGRAM IN THE CITY OF REDWOOD CITY (Killroy Pest <br />Control) seconded by Councilman Rosselli and carried on roll call vote, Councilmen <br />Henderson, Keckley, Rosselli and Mayor Herkner voting yes, Councilmen Bury, Granger <br />and Petersen voting no. <br />
