For purposes of this agreement, the folk~ing defined v,~rds <br /> and terms, shall have the meanings mapecti~y ascribed lhereto: <br /> <br /> a. 'Abanclone~ 5l~opping Cart: A Shopping Cart which has been removed ;rom the <br /> Prerttises of Part~l:ratirtg Owner without Participating Owner's written consent, <br /> irrespective of whether the Shopping Cart is located on private or public properly;, <br /> provided, that Shopping Carts ,,hich are removed from said Premises for <br /> purposes of repair or maintenance and wfllcl~ am in the possesSion or custody of <br /> the party to whom they rtave t:.::n released; shall not be deemed abandoned; <br /> provided, further, that a Shopping Cart located on private pml0erty ovmed or <br /> occupied by the person who has been granted written permission by Participating <br /> Owner to have possession thereof for a period not to exceed seventy-two (72) <br /> consecutive hours, and which Shopping Cart is not visible at atre~t or ground <br /> level ;';~,m the public property aclJacent to such private properly, shall not be <br /> deemed Abandoned. <br /> <br /> b. 'Center': City's Public Works Services Canter, located at 1400 Broadway, <br /> Redwood C~, CA 9406~. <br /> <br /> r,. 'City': Heminabove definecl. <br /> <br /> d. 'Contractor': The person or entfty or entities with whom or which City has <br /> e,-~b~a~:l into an agreement or agreements for the retrieval of Abandoned <br /> Shopping Carte, or who or whidq hae other, vise been authorized by City to <br /> reb-ieve Abandoned Shopping Carts, inducting the Contraotor(e) with such <br /> agreements effective upon tl~e elate of this agmcment and any and ail <br /> successors to said Contractor(s). <br /> <br /> e. 'Oire.-_:~_.~.r': The Diree~r of Community Development, or his or her designee. <br /> <br /> f. 'Holi~ys': The Thursday ~ November appointed as -R'tank~vtng Day in the <br /> State of California; December 25, and January 1. <br /> <br /> <br />
