2 <br />Request of Planning Commissioner, William R. Oeser, for permission to be absent from <br />the City during the months of April and May, 1967, was read for Council's con- <br />sideration. Councilman Petersen moved to approve request, seconded by Council- <br />man Bury and carried. (MINUTE ORDER #67-60) <br />DAMAGE CLAIMS: (1) Leo Dovie and Frances Dovie, 835 Palm Street, for property damages <br />alleged to have been caused by backup of City's storm drains; (2) Wayne and Mary <br />Manion, 1227 Westwood St., for property damages alleged to have been caused by <br />sewer backup; denied and referred to insurance carrier on motion by Councilman <br />Rosselli, seconded by Councilman Petersen and carried. (MINUTE ORDER #67-61A, <br />& 67-61B) <br />DAMAGE CLAIM of Clyde W. Henry, dba Friendly Acres Water Company, a public utility, <br />for damages alleged to be caused by City's taking property of a private public <br />utility for a public purpose without compensation, denied, and denied for filing <br />late, on motion of Councilman Granger, seconded by Councilman Petersen and <br />carried. (MINUTE ORDER #67-62) <br />City Attorney stated separate motion on this claim had been recommended and <br />reviewed several of the details concerning allegations made which he stated <br />were quite confusing and could not understand why claim made at this late date. <br />City Attorney also stated he would recommend that Council, besides denying claim <br />as recommended, authorize him to do further discovery work and also retain <br />Harold Heidrick, Engineer, to perform further investigation services for a few <br />days to check out this claim. He advised inventory of the Friendly Acres <br />Water Company had never been completed and until an agreed inventory had been <br />reached no price could be set on purchase of the system. He stated funds were <br />available for this extra work from his present contract. <br />Councilman Granger moved to authorize City Attorney to commence discovery pro- <br />ceedings and retain services of Mr. Heidrick as recommended, seconded by Coun- <br />cilman Rosselli and carried. (MINUTE ORDER #67-63) <br />Councilman Rosselli asked that City Manager made a general progress report on the <br />Friendly Acres Water System. City Manager stated he would check with City <br />Attorney on status of acquisition of this system and also report on intended <br />construction in this area. (Memo 3/28/67) <br />Councilman Rosselli asked that City Manager also made a report to Council on <br />the Farm Hill Land Slide. Councilman Bury commented on excellent article con- <br />cerning landslides which appeared in today's press and also mentioned how this <br />area had been included on television recently by the Engineering Society. <br />(Memo 3/28/67) <br />Councilman Petersen reported on a meeting to be held in San Francisco March 30, <br />Palace Hotel, concerning a report on "mass transit" and asked that a member of the <br />Transportation Committee be authorized to attend. Mayor Herkner agreed authori- <br />zation be given, if no objections. (Memo 3/28/67) <br />ACCOUNTS PAYABLE, Nos. 60310 to 6o613, totaling $124,227.24, were approved on motion <br />OAT V <br />of Councilman Rosselli, seconded by Councilman Keckley and carried. <br />
