34 <br />Councilman Rosselli moved to introduce Ordinance amending Section 31.7 of <br />Ordinance No. 1130, the Redwood City Zoning Ordinance, relating to excavations <br />and grading, seconded by Councilman Keckley. <br />Councilman Petersen expressed his contention proposed ordinance not necessary <br />but if not opposed by contractors and developers' associations, he would not <br />oppose its adoption. Councilman Henderson questioned whether proposed ordinance <br />would provide better protection to individual home owners on graded or hillside <br />sites. City Manager advised he could not give this complete assurance, but <br />that it would give the City a chance to look at property in hillside areas before <br />grading started and at least could help protect. <br />Councilman Keckley asked whether any City ordinance provided for clean-up of <br />public rights of way after grading and hauling. City Manager advised where <br />these problems existed in the past, a contact with persons responsible had resulted <br />in cooperation in most cases, but would ask City Attorney to speak on legal con- <br />trols. City Attorney advised this problem was specifically covered by the <br />State Highway Code which provided penalties for litter of highways, etc. <br />Motion carried.' <br />PUBLIC HEARING, Application of Charles Shawback to amend the Zoning Map to rezone <br />property located along Toyon Way, being Lots 10 through 20, Block 20, Highlands <br />of Emerald Lake No. 1, from R-1-7 and RH to R -1-7-P and RH-P, declared open and <br />affidavits of publication and mailing ordered filed. Report of Planning Com- <br />mission read which stated, after a public hearing at which no protests had been <br />received, it was recommended that Lots 14 through 16 and Lots 18 through 20, <br />Block 20, Highlands of Emerald Lake No. 1, be rezoned from R-1-7 to R -1-7-P <br />and That Lots 10 through 13 and Lot 17, Block 20, Highlands of Emerald Lake <br />No. 1, be rezoned from RH to RH-P. Staff reported the area in question was <br />recently a part of annexation proceedings into the City', the 91,000 sq. ft. area <br />is in single ownership and contained 11 subdivided lots, 8 of which fronted on <br />unimproved cul-de-sac named Toyon Way (one of the 8 also fronting on Jefferson <br />Avenue); remaining 3 lots fronting on Jefferson Avenue. <br />It was further reported there is a single family dwelling and swimming pool on <br />a portion of the site, remaining area undeveloped; situation on a knoll of a <br />hill, with approximately 6-10 vertical change in elevation along the front of <br />lots facing Jefferson Avenue. It was pointed out that prior to annexation the <br />area was prezoned to two classifications, 7 lots classified as R-1-7 and others <br />as RH. It was also reported how this area could lend itself to a "planned <br />development" as requested. <br />It was further reported there is a single family dwelling and swimming pool on <br />a portion of the site, remaining area undeveloped; situated on a knoll of a hill, <br />with approximately 6-10 vertical change in elevation along the front of lots <br />facing Jefferson Avenue.
