36 <br />City Attorney explained limitation would still be set at 11 lots, and could be <br />done without subdividing, as Windsor Garden development. <br />Mrs. Tyson, 839 Vista Drive, advised she had circulated the <br />protesting petition and more signatures could have been <br />obtained in protest if more time had been possible to <br />obtain same, She protested rezoning as roads inadequate <br />for further density. <br />Harry Bontempi, 180 Atherwood, owner of property in the <br />area, stated he had been instigator of the Vista Drive <br />Annexation and protested change of zoning as had annexed <br />with the idea single family dwellings would prevail. <br />Alfred Dixon, 857 Vista Drive, advised he had attended <br />public hearing of Planning Commission and no protest made <br />at that time because of his limited information on concept <br />of "P" Combining district. Because of the dangers implied <br />by this type of zoning and after ascertaining from his <br />neighbors their objections, protest petition had been <br />submitted. <br />Councilman Petersen moved to close the public hearing, seconded by Councilman <br />Rosselli. Councilman Rosselli moved to deny the rezoning, seconded by Coun- <br />cilman Henderson. <br />Mr. Shawback, applicant for rezoning request, asked that <br />he be allowed to appear before Council in his own behalf. <br />At recommendation of City Attorney that Council re -open the public hearing, if <br />Council desired to allow applicant to appear, Councilman Granger moved to <br />re -open the public hearing, seconded by Councilman Bury and carried. <br />Mr. Shawback, 828 Toyon Way, stated he had always wanted <br />to build on top of the knoll on his property and had <br />hoped to build a hacienda style development in townhouse <br />aspect covering 11 lots, and asked that this matter be <br />referred back to Planning Commission for further study <br />if rezoning not granted. <br />Councilman Petersen moved to close the public hearing, seconded by Councilman <br />Rosselli and carried. <br />Councilman Rosselli moved to deny the application for rezoning, seconded by <br />Councilman Granger. Councilman Rosselli stated his motion based on the fact <br />annexation encouraged and since prezoning had been made prior to annexation, <br />the rezoning requested at this time would not create a good image. Councilman <br />Henderson stated she opposed rezoning in order to retain quality residential <br />zoning in the hillside areas. Motion carried. (MINUTE ORDER #67-72) <br />Councilman Keckley moved to request that Planning Commission be asked to make a <br />thorough study of the "P" Combining District with a breakdown of allowable <br />density by zone, and make a recommendation for controls, seconded by Councilman <br />Henderson. Councilman Henderson questioned possibility of placing this "P" <br />Combining District under a moratorium if a response not possible in the near <br />future. City Attorney responded that City cannot refuse to accept applications. <br />Councilman Keckley amended motion to state that a report be submitted in three <br />months, (July 24th), Motion carried, Councilman Granger voting no. <br />(MINUTE ORDER #67-73) <br />Southern Pacific Parking Lot (bounded by James Avenue, Winklebleck Street and Califor- <br />nis Street) discussion requested by Charles K.
